(a) For initial claims effective March 15, 2020 or thereafter, the requirement under Wyoming Statute §27-3-306(a)(i)(B) that an individual must register for work with the department of workforce services and actively seek work in accordance with these regulations unless they are recalled to full-time work within twelve (12) weeks shall be waived for claimants who are subject to involuntary unemployment lasting longer than twelve (12) weeks if the extended period of unemployment is the result of the public health emergency created by the COVID-19 virus and the employer intends to recall the claimant to full-time work. If the claimant normally worked less than thirty-five (35) hours per week while earning qualifying wage credits, the claimant shall be considered returning to full-time work if returning to the same number of hours normally worked for the employer during the base period.
(b) In order to qualify for the waiver provided in subsection (a), the claimant shall provide notification of initial job attachment as required by Chapter 24, Section 3 of these Rules, and shall notify the Division of extended job attachment at the end of an initial twelve (12) week period and every four (4) weeks thereafter.
(c) With each notification required by subsection (b), the Division shall notify the employer that the claimant has stated he is job attached. The claimant is not job attached if the employer notifies the Division, in writing, within twenty-eight (28) days from the mailing of the Division's notice or by April 30, 2020, whichever is later, that the claimant will not be recalled to work. Claimants who are deemed not to be job attached under this Section have seven (7) days from the date of notice to register for and actively seek work.
(d) This Section shall not extend or expand a claimant's eligibility for benefits beyond the total benefit eligibility determined by the Division.
(a) The requirements that a claimant actively seek work and be able and available for work pursuant to W.S. §27-3-306(a)(i) and (iii) shall not be applicable for any week in which a claimant with no available suitable work has been personally ordered or instructed by a public official having jurisdiction or a health care provider to self-isolate or quarantine as a result of exposure or possible exposure to the COVID-19 virus.
(b) In order to be eligible for the amended requirements provided in subsection (a) of this Section, claimants must be otherwise eligible for benefits.
(c) The amended requirements provided in subsection (a) apply only to claimants who have no suitable work available, including telework and remote work, and do not relieve a claimant from their statutory obligations to register for work with the Division pursuant to W.S. §27-3-306(a)(i) or their obligations to apply for available suitable work and accept any offer of suitable work pursuant to W.S. §27-3-311(a)(ii) and (iii).
(d) In order to establish and maintain eligibility for the amended requirements provided in subsection (a) of this Section, claimants shall provide to the Division the name of the public official with jurisdiction or health care provider who instructed the claimant to self-isolate and the anticipated duration of self-isolation required by the public official or health care provider. The information required by this subsection shall be included with initial claims for benefits and claims for continuing benefits required by Chapter 20 of these Rules.
(a) At the time of an employee’s separation from employment for any reason, employing units shall provide individual notice of the potential availability of unemployment compensation benefits to any employee who separates from employment.
(b) In addition to the records required by Chapter 11, Section 1 of these Rules, a record of the notice required by this Section shall be maintained by each employing unit.
(c) The record of notice required by this Section is a record prescribed by the Commission pursuant to W.S. § 27-3-502(e), and is required for compliance with the Wyoming Unemployment Security Act.
(d) The record of notice required by this Section is a record subject to inspection pursuant to Chapter 11, Section 2 of these rules and W.S. § 27-3-502(e).
(e) The notice required by this subsection may be provided to the separating employee in person, by email, or by mailing a copy of the notice to the separating employee’s last known address.
