DISQUALIFICATION FOR INVALID CLAIM

Section 1. When Initial or Additional Claim. A claimant who has filed an invalid claim for benefits shall be disqualified. In the case of a nonfraudulent misrepresentation made on an initial or additional claim, the disqualification shall be from the time of the misrepresentation to the time the claimant informs the Commission of the correct facts.

Section 2. Weekly Claim. In the case of a weekly claim where a claimant makes a nonfraudulent misrepresentation, he shall be disqualified only to the extent the misrepresentation increased the amount of benefits to which he would otherwise be entitled. When a claimant makes a fraudulent misrepresentation with intent to increase the amount of benefits to which he would otherwise be entitled on a weekly claim, he shall be totally disqualified for benefits for that week or weeks.
