Section 1. Filing a New or Additional Claim for Benefits. Any individual claiming benefits for unemployment under the Wyoming Employment Security Law shall proceed as follows:
(a) An individual residing in Wyoming may file a new or additional claim for unemployment benefits in person at any Wyoming Employment Resources Center. An individual residing in Wyoming may file a new claim by telephone provided that he subsequently reports in person as directed by the claims office not later than 19 days from the effective date of the claim. If the claimant does not report in person as directed, the claim is invalid. If the claimant does report as instructed, he is considered registered for work as long as he completes his registration in full at that time. An individual residing in Wyoming may also file an additional claim by telephone.
(b) The Division may allow an individual to file a new or additional claim for unemployment benefits and work registration by telephone.
(c) The Division may allow an individual to file a new or additional claim for unemployment benefits and work registration by the Internet, using the Division's approved web site claim application.
(d) The effective date of a new claim or an additional claim shall be the Sunday prior to the day when the individual first appeared at the claims office, completed an Internet claim, or telephoned the claims office for the purpose of initiating a new unemployment insurance claim or reopening an existing claim following a period of unemployment, unless the claimant requests that the claim be effective the following Sunday or unless the claimant has excessive earnings during that week and is separated from employment.
(e) When it is impractical, as determined by the Division, for an unemployed individual to report either to a Division Office or to an itinerant representative as provided in Section 1 of this Regulation, the effective date of a new or additional claim filed by mail shall be the Sunday prior to the day in which such individual mails or phones his request for registration and benefit claim forms to his nearest Wyoming Employment Resources Center; provided that such individual mails such completed forms not later than the seventh day following the date on which the requested forms were mailed to him. If such individual fails to mail his registration and claim as provided above, such individual's claim for benefits shall be effective as of the Sunday prior to the day on which such completed forms are mailed; provided that failure to return completed forms within the time prescribed above may be excused if good cause for such delay is established to the satisfaction of the Division.
(f) The effective date of a new or additional claim filed by an individual located in an area served by an itinerant representative of the Division shall be the Sunday prior to the individual's first day of filing a claim for unemployment, provided such individual registers for work and makes a claim for benefits with an itinerant representative on the first visit of such representative following the commencement of the individual's unemployment; and provided further that if an individual fails to register and file a claim for benefits upon such first visit of an itinerant representative he may register for work and claim benefits upon the next visit of an itinerant representative and such claim will become effective as if he had registered for work and claimed benefits upon the first visit, if good cause for failure to register and file earlier is established to the satisfaction of the Division.
(g) A new or additional claim shall set forth the following:
Section 2. Filing Continued Claims for Benefits
(a) In order to maintain continuing eligibility for benefits with respect to any weeks of unemployment during any continuous period of unemployment, such individual shall continue to report in the manner and on the dates and file claims as directed by the Division. No continued claim shall be valid until the claimant shall furnish to the Division a signed claim for benefits on a form provided by the Division or file the claim on the Division's telephone voice response system, on which he shall set forth the following:
(b) Each continued claim in any period of continuous unemployment shall be mailed, filed in person, or filed by telephone not later than Saturday following the week ending date covered by the claim(s). Failure to return completed forms within the time prescribed may be excused if good cause for such delay is established to the satisfaction of the Division.
(c) Where a continuous period of unemployment is terminated or interrupted by reemployment or any other event which prevents continuing eligibility for benefits, a claimant, in order to receive benefits for any week of unemployment for which he was in all respects eligible before such termination or interruption, shall furnish to the Division a signed claim or file a claim on the Division's telephone voice response system for benefits for such weeks. Such claim must be filed by the claimant within fourteen (14) days after the end of the week for which benefits are claimed. Failure to file within the time prescribed may be excused if good cause for such delay is established to the satisfaction of the Division.
Section 3. Continuing of Claims When Claimant Moves to Another Locality. An individual moving to another locality in Wyoming after filing an initial claim for benefits may be permitted to continue his claim for unemployment by reporting to a local office in his new community, to an itinerant representative, by mail, or by telephone, as directed.
Section 4. Withdrawal of Initial Claim. Initial claims may be withdrawn:
(a) By the claimant, only on written request, if that request is filed within seven (7) days after the claim is filed, except as provided under the Interstate Agreement for Monetary Eligibility.
(b) By the Division:
(i) If the claimant is not unemployed during the first week after the effective date of the initial claim; or
(ii) If, as of the effective date of the claim, the claimant has not met the requirements of W.S. 27-3-306(d), or W.S. 27-3-311(a) after disqualification under that section.
