(a) Pursuant to the authority vested in the Wyoming Livestock Board by virtue of W.S. §11-18-103 (a) (v), Wyoming Statutes 1977, the following rules are hereby promulgated.
(a) These rules are adopted to enhance the marketability of Wyoming Bovinae, address certain issues regarding the eradication of Brucellosis and preserve Wyoming's Brucellosis Class Free Status. It is imperative that Wyoming livestock producers and veterinarians statewide continue to be proactive in Brucellosis surveillance and prevention. Brucellosis Class Free Status must not equate to complacency.
(a) The following definitions are applicable for these rules. If not defined, or listed below, refer to the United States Department of Agriculture, Animal Plant Health Inspection Service's Brucellosis Eradication Uniform Methods and Rules.
(i) 'Accredited Veterinarian' means an individual who is licensed to practice veterinary medicine and is accredited by the USDA/APHIS/VS.
(ii) 'Approved Livestock Market' means a livestock market that is approved by the State of Wyoming to handle cattle under conditions required by the Cooperative State-Federal Brucellosis Eradication Program.
(iii) 'B Brand' means a 2' X 3' hot iron single B character brand applied to either side of the tail-head of a Bovinae indicating that the animal is infected with Brucellosis.
(iv) 'Board' means the Wyoming Livestock Board, state agency 051, 2020 Carey Avenue, 4th Floor, Cheyenne WY 82002-0051, (307) 777-7515.
(v) 'Board Approved Individual Identification' means a permanent, silver, metal USDA/APHIS/VS tag or a permanent, orange metal USDA/APHIS/VS Brucellosis Vaccination tag placed in the ear of a Bovinae.
(vi) 'Bovinae' means a subfamily classification of the family Bovidae. For the purposes of these rules, Bovinae specifically means animals in the genus Bos (bovine animals) and animals in the genus Bison (domestic bison animals) regardless of age or gender.
(vii) 'Brucellosis' means an infectious disease of animals and humans caused by Brucella abortus.
(viii) “Brucellosis Class Free Status” means a classification standard for a state that has been certified as fulfilling the requirements of this status on initial classification or reclassification by the state animal health official, and the USDA/APHIS/VS. Included among the requirements for Class Free Status are that the Bovinae herds in the state or area within the state must have remained free from infections with field strains of Brucella abortus for at least twelve (12) months.
(ix) “CFR” means the United States Code of Federal Regulations; 9 CFR; §78.1, 78.2, 78.3, 78.4, 78.5, 78.6, 78.7, 78.8, 78.9, 78.10, 78.11, 78.12, 78.13, 78.14, 78.15, 78.16, 78.17, 78.18, 78.19, 78.20, 78.21, 78.22, 78.23, 78.24, 78.25, 78.26, 78.27, 78.28, 78.29, 78.30, 78.31, 78.32, 78.33, 78.34, 78.35, 78.36, 78.37, 78.38, 78.39, 78.40, 78.41, 78.42, 78.43, 78.44; 1-1-97 Edition; Pages 210-250.
(x) “Commuter Agreement” means a written agreement which allows for the movement of Bovinae between Wyoming and adjacent states. A Commuter Agreement must be approved by state animal health officials in the state of origin and state of destination prior to movement.
(xi) “Direct Movement” means movement in which the Bovinae are not unloaded en route to their final destination.
(xii) “Exposed Bovinae” means any Bovinae, which has been exposed to a Reactor Bovinae.
(xiii) “Farm or Ranch of Origin” means the farm or ranch on which Bovinae have resided immediately prior to testing for Brucellosis.
(xiv) “Herd” means all Bovinae under common ownership or supervision that are grouped on one or more parts of any single premises; or all Bovinae under common ownership or supervision on two or more premises that are geographically separated but in which the animals have been interchanged or had contact with animals from different premises. It will be assumed that contact between animals of the same species on the different premises has occurred unless the owner establishes otherwise and the results of the epidemiologic investigation are consistent with the lack of contact between premises.
(xv) “Immediate Slaughter” means the slaughter of a Bovinae within three (3) working days at a Recognized Slaughter Establishment.
(xvi) “K-Lot Agreement” means a contractual agreement with the Board and feedlot operator which allows for the feeding of non vaccinated, female Bovinae twenty four (24) months of age and older in a feedlot based upon the operation’s compliance with the provision of the Agreement. These Bovinae are not to remain in Wyoming for more than one hundred fifty (150) days and must be shipped in Direct Movement to Immediate Slaughter. All Bovinae will be identified with Board Approved Individual Identification upon arrival. Bovinae from a Class A State will be tested negative for Brucellosis prior to entry.
(xvii) “O-Lot Agreement” means a contractual agreement with the Board and feedlot operator which allows for the feeding of non vaccinated, female Bovinae under twenty four (24) months of age in a feedlot based upon the operation's compliance with the provision of the Agreement. These Bovinae are not to remain in Wyoming for more than two hundred fifty (250) days and must be shipped in Direct Movement to Immediate Slaughter. All Bovinae will be identified with Board Approved Individual Identification upon arrival. Bovinae from a Class A State will be tested negative for Brucellosis prior to entry.
(xviii) 'Official Calfhood Vaccinate' means a female Bovinae that has been inoculated subcutaneously with a USDA/APHIS/VS approved Brucella vaccine, by a State or Federal representative or an Accredited Veterinarian using the approved vaccination procedure outlined in the UMR. The Bovinae must be properly identified as a vaccinate by Board Approved Individual Identification and a vaccination tattoo and must have been reported on the appropriate certificate to the appropriate State and Federal animal health agency. Verification of official vaccinate status requires evidence of the vaccination shield.
(xix) 'Parturient' means a Bovinae that is visibly prepared to give birth or within two weeks of giving birth.
(xx) 'Permit' means an official document (VS Form 1-27) that is issued by a State or Federal representative or by an Accredited Veterinarian. The Permit is required to accompany all Brucellosis Reactor Bovinae and Brucellosis Exposed Bovinae that are being moved to a specified destination.
(xxi) 'Post Parturient' means a Bovinae that has recently given birth.
(xxii) 'Quarantine' as used in these rules, means an official document, issued by the Board, which restricts the movement of specific Bovinae and may set forth requirements regarding their testing or qualification for import.
(xxiii) 'Reactor Bovinae' means any Bovinae which the designated Brucellosis epidemiologist classifies as Reactor based on the serological results as defined in the UMR or from which a field strain isolate of Brucella abortus has been confirmed by a recognized laboratory.
(xxiv) 'Recognized Slaughter Establishment' means any slaughter establishment operating under the provisions of the Federal Meat Inspection Act or the Wyoming Wholesome Meat Act of 1969.
(xxv) 'Replacement Bovinae' means Bovinae which will be used as breeding stock.
(xxvi) 'S Brand' means a 2' X 3' hot iron single S character brand applied to either side of the tail-head of a Bovinae signifying that the animal is a Brucellosis suspect.
(xxvii) 'Test-Eligible' means all Bovinae eighteen (18) months of age and over (as evidenced by the loss of the first pair of temporary incisor teeth), except steers, spayed heifers and official calfhood vaccinates of the dairy breeds under twenty (20) months of age, and official calfhood vaccinates of beef breeds under twenty four (24) months of age. (Presence of the first pair of fully erupted permanent incisor teeth is evidence that the animal has reached twenty four (24) months of age.) All Bovinae that are Parturient or Post Parturient are test eligible regardless of age.
(xxviii) 'UMR' means the Brucellosis Eradication Uniform Methods and Rules, published by the United States Department of Agriculture, Animal Plant Health Inspection Service.
(xxix) 'USDA/APHIS/VS' means the United States Department of Agriculture, Animal Plant Health Inspection Service, Veterinary Services.
(xxx) 'Vaccination Eligible' means sexually intact female Bovinae between the ages of four (4) and twelve (12) months of age.
(xxxi) 'Wyoming Licensed Veterinarian' means an individual who is licensed by the State of Wyoming to practice veterinary medicine in Wyoming.
(a) Penalties for a violation of these rules will be pursuant to law.
(a) The United States Department of Agriculture, Animal Plant Health Inspection Service's Brucellosis Eradication: Uniform Methods and Rules, Effective February 1, 1998, APHIS 91-45-011 shall be adopted by the Wyoming Livestock Board insofar as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. This document is available to the public at the office of the Board.
(b) The Code of Federal Regulations; 9 CFR; §78.1, 78.2, 78.3, 78.4, 78.5, 78.6, 78.7, 78.8, 78.9, 78.10, 78.11, 78.12, 78.13, 78.14, 78.15, 78.16, 78.17, 78.18, 78.19, 78.20, 78.21, 78.22, 78.23, 78.24, 78.25, 78.26, 78.27, 78.28, 78.29, 78.30, 78.31, 78.32, 78.33, 78.34, 78.35, 78.36, 78.37, 78.38, 78.39, 78.40, 78.41, 78.42, 78.43, 78.44; 1-1-97 Edition; Pages 210-250, shall be adopted by the Wyoming Livestock Board insofar as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. This document is available to the public at the office of the Board.
(a) Before a change in ownership can occur for any Wyoming origin female Bovinae over twelve (12) months of age, born in Wyoming after March 1, 1999, the Bovinae must be an Official Calfhood Vaccinate.
(i) The following are exemptions from the mandatory vaccination requirement:
(A) Bovinae consigned for Immediate Slaughter at a Recognized Slaughter Establishment and moving under Direct Movement from a Herd to the Recognized Slaughter Establishment;
(B) Bovinae which are moving under Direct Movement to an Approved Livestock Market where they will be sold and destined to a state or nation which will accept non vaccinated Bovinae;
(C) Bovinae consigned directly to a state or nation which will accept non vaccinated Bovinae;
(D) Spayed female Bovinae which are identified with a metal eartag approved by the Board and placed in the right ear;
(E) Bovinae which are moving under Direct Movement to an approved K-Lot; or
(F) Bovinae which are moving under Direct Movement to an approved O-Lot.
(b) All Brucellosis vaccination certificates must be submitted directly to the Board by the Accredited Veterinarian within two (2) weeks of the vaccination being performed.
(a) All Bovinae imported into Wyoming must meet the import requirements set forth in Chapter 8 of the Board’s official rules and regulations. A copy of this document may be obtained from the office of the Board.
(b) Wyoming does not allow the importation of female Bovinae which are not Official Calfhood Vaccinates.
(i) The following categories of imported Bovinae are exempt:
(A) Bonafide Wyoming origin heifers of Vaccination Eligible age may return to Wyoming if they are being imported pursuant to a Commuter Agreement. Following their return these Bovinae are subject to mandatory vaccination requirements as described in Section 6;
(B) Bovinae which are moving under Direct Movement to an approved K-Lot;
(C) Bovinae which are moving under Direct Movement to an approved O-Lot;
(D) Bovinae which are imported with certification and identification that they have been spayed prior to import;
(E) Bovinae imported with prior Board approval to be spayed by a Wyoming Licensed Veterinarian within two (2) weeks of arrival. These animals will be quarantined until spayed and held separate and apart from all other animals;
(F) Vaccination Eligible Bovinae imported with prior Board approval to be vaccinated by an Accredited Veterinarian within two (2) weeks of arrival. The animals will be quarantined until vaccinated and held separate and apart from all other animals;
(G) Female Bovinae younger than six (6) months of age, nursing their import eligible mothers and imported with prior Board approval will be subject to the requirements in Section 6;
(H) Vaccination Eligible Bovinae imported under Direct Movement from a Herd to an Approved Livestock Market where they will be spayed or vaccinated; or
(I) Female Bovinae not yet Vaccination Eligible age, not accompanying their mothers may be imported but will be subject to the requirements of Section 6.
(a) As per recommendations from the 1998 USDA/APHIS/VS Wyoming Brucellosis Station Review Report, testing of all Test Eligible Replacement Bovinae at change of ownership is strongly encouraged by the Board. This voluntary testing of Replacement Bovinae will be done on a statewide basis and is to protect the Wyoming Bovinae industry from the disease Brucellosis and to enhance marketability of Wyoming Bovinae. If adequate surveillance numbers are maintained, this testing will remain voluntary. The Board will continually monitor this surveillance to determine its effectiveness and may require testing if adequate surveillance numbers are not obtained.
(a) Prior to July 1, 2000, the livestock owner is encouraged to identify all Test Eligible Bovinae with Board Approved Individual Identification prior to a change of ownership.
(b) After July 1, 2000, it is the livestock owner's responsibility to ensure that all Test Eligible Bovinae which leave a Herd are identified with Board Approved Individual Identification prior to a change of ownership. The Accredited Veterinarian who authorizes the identification of the animal shall report this identification to the cooperating animal health agencies on forms provided by the Board. Bovinae already identified with Board Approved Individual Identification do not need any additional identification. If no Board Approved Individual Identification is present, a silver USDA/APHIS/VS tag must be inserted in the ear of the Bovinae. No report is necessary on Bovinae already identified with Board Approved Individual Identification. Board Approved Individual Identification can only be removed upon written approval of the Board.
(c) The following are exempted from this identification requirement:
(a) All dairy Herds will be submitted to quarterly brucellosis ring tests and results will be reported to the Board, Wyoming State Veterinarian and the USDA/APHIS/VS Area Veterinarian in Charge for Wyoming in accordance with the UMR.
(a) Bovinae which are tested in Wyoming and give a suspicious reaction to an official blood test for Brucellosis shall be Quarantined in a pen at the Farm or Ranch of Origin and subject to an official retest made not less than thirty (30) nor more than sixty (60) days from the date of collecting the blood sample with the suspicious reaction, and shall be dealt with in a manner which is consistent with procedures outlined in the UMR, insofar as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. All Bovinae which are tested and give a suspicious reaction will have a Board Approved Individual Identification tag placed in their left ear which may only be removed upon negative test results for Brucellosis and release of Quarantine by the Board.
(a) The Board, or its authorized representative, shall issue a Quarantine of all Reactor Bovinae and the Herd associated with the Reactor Bovinae. Reactor Bovinae and other Bovinae in the associated Herd shall be held subject to the Quarantine and shall not be offered for sale, or given away except with written permission of the Board or its authorized representative. Quarantined Bovinae must be detained at the Farm or Ranch of Origin and may be slaughtered in accordance with W.S. §11-19-104, or may be slaughtered on premise by the owner upon written approval of the Board.
(a) Movement of Quarantined Bovinae will only be allowed by Permit as outlined in the UMR, insofar as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. Reactor Bovinae must be B Branded prior to movement. All other Exposed Bovinae must be S Branded prior to movement. A Permit may only be issued under the following conditions:
(a) Release of Quarantine is contingent upon satisfactory completion of all conditions set forth in the UMR for handling infected or restricted Herds, and with approval of state and federal animal health officials.
