(a) Pursuant to the authority vested in the Wyoming Livestock Board by virtue of W. S. §11-18-103 (a) (v), the following rules are hereby promulgated.
(a) These rules are adopted to establish an Ovine and Caprine Scrapie protocol for the State of Wyoming and to assist in preventing the spread of Scrapie through herd depopulation and/or enrollment in the Voluntary Scrapie Flock Certification Program (VSFCP).
(a) The following definitions are applicable for implementing these rules.
(i) 'Board' means the Wyoming Livestock Board, State Board 051, whose current address is 2020 Carey Avenue, 4th Floor, Cheyenne WY 82002-0051, (307) 777-7515.
(ii) 'Caprine' means a ruminant mammal of the genus Capra.
(iii) 'CFR' means the Code of Federal Regulations; 9 CFR §79.1, 79.2, 79.3, (1-1-97 Edition); Pages 250-254.
(iv) 'Contemporary Birthing Group' means animals born during the same birthing season and in the same facility.
(v) 'Epidemiology' means the tracing of individual Ovine or Caprine health, origin, and movements.
(vi) 'Exposed Ovine, Caprine or Flock' means any Ovine or Caprine or group of Ovine or Caprine which have been in the same flock at the same time within the previous sixty (60) months as a scrapie positive Ovine or Caprine.
(vii) 'Individual Identification' means an ear tag with nine alpha numeric characters conforming to the National Uniform Ear Tagging System, or other identification approved by the Board.
(viii) 'Infected Ovine, Caprine or Flock' means any Ovine or Caprine, or group of Ovine or Caprine, which have tested positive for Scrapie by methods approved by the Board.
(ix) 'Flock Plan' means a plan developed by the flock owner with cooperation and approval from the State Scrapie Coordinator and the State Veterinarian, to identify animals, depopulate infected and/or High Risk animals and to prevent the spread of Scrapie. The Flock Plan must include enrollment in the VSFCP.
(x) 'High Risk' means any Ovine or Caprine determined by epidemiologic investigation to face a high risk of developing clinical Scrapie because the Ovine or Caprine was:
(A) Progeny of a Scrapie-positive dam; born in the same Contemporary Birthing Group as a Scrapie-positive Ovine or Caprine.
(B) Born in the same Contemporary Birthing Group as progeny of a Scrapie-positive dam.
(xi) 'National Veterinary Services Laboratory (NVSL)' means a diagnostic laboratory which is part of the United States Department of Agriculture.
(xii) 'Ovine' means a ruminant mammal of the genus Ovis.
(xiii) 'Premise' means the ground, area, building and equipment occupied by one or more Ovine or Caprine.
(xiv) 'Quarantine' means a document issued by the Board which restricts movement of Ovine and Caprine.
(xv) 'Scrapie' means a nonfebrile, transmissible, insidious, degenerative disease affecting the central nervous system of Ovine and Caprine and causing a spongiform encephalopathy.
(xvi) 'State Scrapie Coordinator' means an employee of the United States Department of Agriculture, Animal Plant Health Inspection Service authorized to perform Voluntary Scrapie Flock Certification Program duties.
(xvii) 'Susceptible Species' means any species of animal which could contract Scrapie.
(xviii) 'Volunteer Scrapie Flock Certification Program (VSFCP)' means a federally approved program designed to monitor flocks and certify the Scrapie status of the Ovine or Caprine that are enrolled in the VSFCP.
(xix) 'WSVL' means the Wyoming State Veterinary Laboratory, located in Laramie, Wyoming.
(xx) 'Wyoming Sheep Quality Assurance Panel (WSQAP)' means an advisory group to the Board to develop policy and protocol for the Wyoming Scrapie program and appointed by the Board.
(a) The Code of Federal Regulations; 9 CFR §79.1, 79.2, 79.3, (1-1-97 Edition); Pages 250-254, shall be adopted by the Board in so far as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. This document is available to the public at the office of the Board.
(a) When Scrapie is suspected based on clinical evidence or diagnosed by the WSVL and confirmed by the NVSL in Ovine or Caprine the following protocol will be followed:
(i) All Ovine or Caprine, and the Premise on which they reside, will be placed under Quarantine by the Board. The actual physical area of the Quarantine shall be left to the discretion of the State Scrapie Coordinator, State Veterinarian and the WSQAP, but at a minimum shall be any area suspected to have been inhabited or populated by an Exposed Ovine, Caprine or Flock, or High Risk Ovine and/or Caprine. In all cases, the State Scrapie Coordinator and State Veterinarian shall have final authority to describe the area contained within the Quarantine. The Quarantine will remain in effect until such time as the High Risk Ovine or Caprine are depopulated in accordance with these rules and the CFR, and a Flock Plan is approved;
(ii) All Ovine or Caprine which are suspected of having Scrapie, and those which have died of a cause with symptoms suggestive of Scrapie, are required to be tested by the WSVL with confirmation from the NVSL. Other testing methods developed for the diagnosis of Scrapie may be used after being approved by the WSQAP, Board and the State Scrapie Coordinator;
(iii) All Ovine and Caprine on the Premise must be inventoried as to species, breed, sex, and age and must be individually and uniquely identified with identification approved by the WSQAP, Board and State Scrapie Coordinator;
(iv) All Exposed Ovine and Caprine maintained on the Premise, must be enrolled in a VSFCP Flock Plan. The Flock Plan must be approved and accepted by the WSQAP, Board and State Scrapie Coordinator. No High Risk Ovine or Caprine may exist in the VSFCP Flock Plan or on the Premise;
(v) The records of any Ovine and/or Caprine which may have been exposed to, or come in contact with, any Exposed Ovine, Caprine or Flock, or High Risk Ovine and/or Caprine on the Premise, or which have populated or inhabited any area included within the Quarantine area, that have been dispersed from the Premise within the last five (5) years must be provided by the producer to the WSQAP, Board and the State Scrapie Coordinator within thirty (30) days of Quarantine. These records must include the purchaser's name, complete address and telephone number. Tracing and notification of all purchasers of breeding Ovine or Caprine from the Infected Flock will be completed by the State Scrapie Coordinator in cooperation with the State Veterinarian; and
(vi) The records of Ovine or Caprine purchases and additions into the Infected Flock for five (5) years prior to the diagnosis of Scrapie must be provided by the producer to the WSQAP, Board and State Scrapie Coordinator within thirty (30) days of Quarantine.
(a) A flock and Premise will no longer be considered an Infected Flock and the Quarantine will be released by the Board when all requirements of the CFR are complied with in addition to these rules.
(a) No infected Ovine, Caprine or carcass will be removed from the Premise unless accompanied by a written permit issued by a representative of the Board or until the Quarantine is removed.
(a) Animal depopulation and carcass disposition will be done using commonly accepted methods approved on a case by case basis by the WSQAP, Board and the State Scrapie Coordinator.
