These rules are adopted to further the development of community based juvenile services for at risk youth and families and to assist the Governor and the Departments of Family Services, Health, and Education in operationalizing this through a maximum of three pilot projects. Authorization by statute is limited to June 30, 1999. Due to this time limitation, these rules focus on the process required for assessment, planning, operation and evaluation. Actual levels of services must meet the individual needs of pilot communities and fulfill the standards established under W.S. 14-9-101 through W.S. 14-9-108.
If any provision of these rules or the application thereof is held invalid, the invalidity shall not affect other provisions or applications of these rules. To the extent that these rules can be given effect without the invalid provision, the provisions of these rules are severable.
(a) 'Action Plans' are detailed methods specifying how a strategy is implemented. These break strategies into manageable parts for coordinated implementation of goals and objectives.
(b) 'At-risk Youth' means a child under the age of majority, who presently has a high risk of contact with the juvenile justice system or has had contact with the juvenile justice system, but does not include children whose primary concern is a physical disability.
(c) 'Community Assessment' is a comprehensive process of identifying community assets and needs to effectively plan and develop a service system. This process must involve key population groups and constituencies.
(d) 'Community Juvenile Services Boards' means a community based board which may receive funding, employ staff and expend resources to provide or contract for the provision of juvenile services.
(e) 'Goals' are the general ends toward which communities direct their efforts. Goals are realistic and achievable, and address issues by stating policy intention.
(f) 'Joint Powers Boards' are local governing bodies consisting of no fewer than five (5) members exercising authority as outlined under W.S. 16-1-101 through 16-1-109.
(g) 'Juvenile Services' means programs or services provided to children at risk of coming under the jurisdiction of the juvenile court, including seriously emotionally disturbed youth.
(h) 'Memorandum of Understanding' is an official agreement between parties that outlines expectations and responsibilities of the consenting parties.
(i) 'Mission' identifies what the pilot project coordinating entity does, why and for whom. A mission states the unique purposes promoted and served by the coordinating entity.
(j) 'Objectives' are clear targets for specific action. An objective is specific, pertinent, attainable, and measurable; it sets the direction for strategies.
(k) 'Outcomes' are quantified results, or impacts, of action. Outcomes are the effects, the results, or impact, of the output.
(l) 'Outcome Measures' are tools, or indicators, to assess the actual impact of the entity's actions. An outcome measure is a means for quantified comparison between the actual result and the intended result.
(m) 'Outputs' are the goods and services produced.
(n) 'Output Measures' are tools, or indicators, to count the services and goods produced. The number of children and families receiving services or the number of services delivered are often used as measures of output.
(o) 'Partnership Agreement' is an informal agreement that includes partnership disclosure and the development of a common purpose and goals.
(p) 'Philosophy' is the expression of core values and operating principles for the conduct of the entity in carrying out its mission. It describes how the entity conducts itself as it does its work.
(q) 'Severely Emotionally Disturbed' youth means a child who has an emotional or mental disturbance that severely limits his development and welfare over a significant period of time and that requires a comprehensive and coordinated system of care in order to meet his needs. The child must be less than eighteen (18) years of age, or less than twenty-two (22) years of age is disabled and receiving special education, and must meet all four (4) of the following:
(A) The child must have a diagnostic screening manual (latest edition) diagnosis (exceptions include V codes, adjustment disorders, mental retardation, and learning disabilities unless they co-occur with psychiatric diagnosis);
(B) The child must have a degree of impairment that consistently prevents him from functioning in at least two (2) of the following life domains: age appropriate self-care, family life, education, community living, personal hygiene, leisure time management and peer relationships. (For infants and toddlers, age 0-2 years, impairment in age appropriate development only);
(C) The disorder must have been present for at least one (1) year or is anticipated to persist for a year or longer on the basis of current (within past year) diagnosis;
(D) The severity of the child's disorder places the child at significant risk for out of school, home or community placement.
(r) 'Situational Analysis' is an evaluation of key factors which influence the success of an agency in achieving its mission and goals. This type of assessment should be quantitative and include external and internal factors. External factors may include economic conditions, population shifts, technological advances, and geographical or statutory changes. Key internal factors may include management policies, resource constraints, organizational structure, automation, personnel, and operational procedures.
(s) 'Strategic Planning' is a long-term, future-oriented process of assessment, goal setting, and decision making that maps an explicit path between the present and a vision of the future, that relies on careful consideration of an organization's capabilities and environment, and leads to priority-based resource allocation.
(t) 'Strategies' are methods to achieve goals and objectives.
The Departments of Family Services, Health and Education shall assist the Governor in administration of the Community Juvenile Services block grant pilot project. The pilot project shall be conducted during the period beginning July 1, 1997 and ending June 30, 1999.
The Community Juvenile Services block grant program is initiated to assist communities in the development and enhancement of locally based services for at-risk youth. The program will allow service decisions to occur at a local level. This service network development will require community based planning and coordination to achieve an effective continuum of care for at-risk youth and families.
(a) Services and the system shall focus on:
(i) Early identification and diversion of children at risk of entry into the juvenile justice system;
(ii) Preventing juvenile delinquency;
(iii) Treating seriously emotionally disturbed youth;
(iv) Creating local, regional and statewide partnerships;
(v) Insuring coordinated transitions within the human service system.
A task force with representation from the Departments of Family Services, Health and Education shall assist the Governor in selecting local governmental entities in not more than three regions to participate in the pilot project. Participation is voluntary and the selected entities may form and operate a community juvenile services board pursuant to a joint powers board agreement or memorandum of understanding. Funding for the pilot project will occur through a grant process.
Upon selection of the pilot sites, an assessment of community needs and assets shall be initiated. This may occur through the community juvenile service board, if established or other community entity. The assessment will provide baseline information for strategic analysis and planning for community services. Technical assistance will be made available in the strategic analysis and planning process.
(a) Opportunity for public participation shall occur and be documented during the strategic analysis and planning process. The planning process must reflect the unique nature of each community and include, at a minimum, the following:

(vi) System to enter into Partnership Agreements with other service providers

Section 10. Operating Budget.
Each community involved in the pilot project shall develop and submit to the Departments of Family Services, Health and Education an operational budget for the local service delivery system. This budget shall detail the expenditure of grant funds for community based service development and provision and any funds proposed for administration of the project. No more than 10% of the grant amount may be used for project administrative costs and may be retained only by the entity directly responsible for project administration. The operating budget must also itemize grant funds which will be subcontracted to other service entities.
Section 11. Performance Evaluation.
An evaluation of the overall pilot project shall be conducted by a team with members from the Departments of Family Services, Health and Education to assess effectiveness and efficiency. Each pilot site will establish outcome and output measures within its strategic plans.
Results of this service system evaluation shall be made available to the Governor no later than December 20, 1998.
Section 12. Data Collection and Reporting.
Strategic plan data shall be forwarded to the Department of Family Services on a quarterly basis. The Department of Family Services shall make this data available to the Governor and Departments of Health and Education.
Section 13. Pilot Project Evaluation.
A systematic evaluation of the Community Juvenile Services block grant pilot project shall be conducted by the Departments of Family Services, Health and Education. Performance indicators for evaluating effectiveness and efficiency shall include:
Such a systematic review will require the sharing and evaluation of service data between the Departments of Family Services, Health and Education.
