Chapter 15: Recovery of Retained Support

(a) If a POWER recipient receives child or spousal support payments directly while a POWER case is active, such payment shall be remitted to the Title IV-A agency. The assignment of support rights covers all support due to any person in the POWER recipient's household who is on the POWER grant and applies to past due support owed at the time the POWER grant went into effect. Therefore, the recipient shall not retain any support payment made on behalf of any person who is on the POWER grant.
(b) If CSED discovers a POWER recipient has retained support assigned to the state, CSED shall verify the recipient has retained child support.
(i) If CSED determines a current POWER recipient has retained a support payment, the information shall be transmitted to the recipient's Benefit Specialist for Title IV-A recovery.
(ii) If CSED determines a prior POWER recipient has retained support payments, the information shall be transmitted to the Title IV-A recovery group at the DFS state office.
If CSED determines an obligee received child support erroneously, the obligee is personally liable for the return of any of those amounts received.
