Section 457 of the Act prescribes the manner in which support collections on all obligations are to be distributed.
(a) By signing an application for, or being a recipient of public assistance under the
Wyoming POWER Program, an obligee shall be deemed to have assigned to DFS all rights they and all other members of the household on the public assistance grant have to child and spousal support, whether accrued, present, or future, and their right to medical support. The assignment shall be governed by the standards set forth in federal and state laws and regulations.
(b) DFS is the assignee of support rights. No act or omission of the obligee shall prejudice the rights of DFS.
No agreement between any obligee and any obligor purporting to relieve the obligor of any duty of support shall reduce or terminate any rights of DFS unless DFS has consented to a written agreement or unless approved by a court in proper proceedings with legally sufficient notice to DFS.
DFS has the power of attorney to act in the name of any recipient of public assistance in endorsing and negotiating all drafts, checks, money orders or other negotiable instruments received by DFS representing support payments for children on whose behalf public assistance is being paid or has been previously paid.
