Chapter 11: Recovery of Retained Support

(a) If an AFDC recipient receives child or spousal support payments directly while his/her AFDC case is active, (s)he must remit the payment to the IV-D agency. The assignment of support rights covers all support due to any person in the AFDC recipient's household who is on the AFDC grant, and applies to past due support that was owed at the time the AFDC grant went into effect. Therefore, the recipient may not retain any support payment made on behalf of any person who is on the AFDC grant.
(b) If the IV-D agency discovers that an AFDC recipient has retained support which is assigned to the state, the agency should attempt to verify that child support has been retained by the recipient through the following means:
(i) canceled checks from the obligor,
(ii) recipient information, or
(iii) checking with the Clerk of the District Court where the support order was entered in an attempt to determine if the recipient turned over the support payment for credit on the Absent Parent's account.
(c) If the IV-D agency determines that a support payment has been retained by a recipient, the information will be transmitted to the recipient's Public Assistance Worker for 'IV-A recovery'. 'IV-A recovery' is the process by which the state recovers the retained support. Rules relating to IV-A recovery are contained in the Division's regulations pertaining to the Overpayment Recovery Program.
(a) If CSES determines that the obligee was paid erroneously, the obligee is personally liable for the return of any amounts received. CSES reserves the right to adjust future payments as a means of recouping an overpayment.
