TUMOR REGISTRY RULES AND REGULATIONS

CHAPTER 1

GENERAL PROVISIONS

Section 1. Authority. The statutory authority for these rules is W.S. 35-1-240(b).

Section 2. Definitions. The following definitions shall apply in the interpretation and enforcement of these rules and regulations.

1. (a) "ACS" - American College of Surgeons Commission on Cancer.
2. (b) "Billing Period" - January 1 through June 30 and July 1 through December 31 of each calendar year.
3. (c) "Cancer" - diagnosis of disease to include carcinoma, sarcoma, melanoma, leukemia and lymphoma.
4. (d) "Case Eligibility Criteria" - Criteria determined by the ACS as reportable cases of cancer, supplied by the state agency.
5. (e) "Case Finding" - Screen hospital listing of patient admit and outpatient visits by ICD code to determine patients with a new diagnosis or history of cancer.
6. (f) "Clinical Laboratory" - a facility for the microbiological, serological, chemical, hematological, biophysical, cytological or pathological examination of materials derived from a human body for the purpose of obtaining information for the diagnosis, prevention or treatment of disease or assessment of medical conditions.
7. (g) "Completed Registration" - all of a cancer patients available data items required by the ACS in format specified in manuals supplied by the State Agency.
8. (h) "Health Care Provider" - person who is licensed, certified or otherwise authorized by the law of this state to provide health care in the ordinary course of business or practice of a profession, but does not include a person who provides health care solely through the sale or dispensing of drugs.
9. (i) "Hospital" - establishments with organized medical staffs, with permanent facilities that include in-patient beds; and with medical services, including physician services and continuous nursing services; to provide diagnosis, treatment, and continuity of care for patients.
10. (j) "Hospital Authority" - administrator or person appointed by the administrator.

(k) 'Hospital Tumor Registrar' - person on staff or contracted by a Wyoming Hospital, who is assigned the responsibility of completed registration of all required cancer cases to the State Agency.

(l) 'Infirmaries of Wyoming Institutional Facilities' - place where ill persons are cared for within lodging facilities owned and operated by the state of Wyoming.

(l) 'ICD' - International Classification of Diseases.

(m) 'Nursing Care Facilities' - a facility which is currently licensed and certified to provide skilled nursing services and intermediate nursing services or intermediate nursing services only.

(n) 'Patient' - an individual who receives or has received health care and includes a deceased individual who has received health care.

(n) 'Patient Follow-up' - annual investigation and recording of patient status and of patient's disease required by ACS.

(p) 'Physician' - term used to indicate individuals appropriately licensed in Wyoming.

(q) 'Private Office' - term used to indicate office space used by physician in private practice.

(r) 'Rules' - are to be construed to embrace and be synonymous with the term 'regulation'.

(s) 'Semi-Annually' - every six months (twice a year). Schedule will be established and agreed on between each individual hospital and the State Agency.

(q) 'Shall' - indicates State Agency requirement.

(r) 'State Agency' - as used in these rules and regulations shall be the Wyoming Department of Health, Division of Preventive Medicine, office of the Wyoming Central Tumor Registry.

Section 3. Applicability.

(a) These regulations shall apply to all hospitals, physicians and other health care providers licensed and performing patient care in Wyoming.

(b) Exception: Wyoming State (Psychiatric) Hospital.
