Section 1. Significant Exposure to Blood or Body Fluids. Following a documented exposure of a health care worker to blood or bodily fluids of a patient that could lead to infection of a communicable disease which is capable of transmission by blood or other body fluids, a health care provider, worker or professional, acting within his scope of practice, may order an appropriate test to be performed on a specimen from the patient by a duly licensed and accredited laboratory.
Section 2. Unavailability of Specimen. If a patient specimen is not available for testing, a health care provider, worker or professional, acting within the scope of his practice, or the Health Officer may, with the patient's consent, order the necessary testing.
Section 3. Court Ordered Testing. If the patient does not consent to testing, the Health Officer or the authority responsible for the care of the patient may apply to the district court for an order to have the necessary testing performed.
Section 4. Confidentiality of Results. Test results will be kept confidential and shall be reported by the health care provider, worker or professional, in accordance with W.S. 35-4-130 through 35-4-134.
Section 5. Official Reports. Laboratory and physician disease reports to the Wyoming Department of Health shall be made on an official state disease report form or the report may be made by telephone or secured fax with confirmation by written form.
