Chapter 1: Public Health Laboratory Testing Fees

Section 1. Authority. The Wyoming Department of Health is promulgating this Rule pursuant to requirements in 2009 Wyoming Session Laws, Chapter 159, Section 048 Department of Health, Footnote 12, and the Wyoming Administrative Procedure Act at W.S. § 16-3-101, et seq.
Section 2. Purpose and Applicability. This Chapter establishes fees charged by the Public Health Laboratory for providing laboratory testing services to other state agencies, local law enforcement entities and other individuals or organizations.
(a) The public health laboratory will provide billing information for each test or collection kit, which includes prepaid tests, to all facilities submitting samples.
(b) Facilities and clients currently on the public health laboratory submitter list will be authorized to submit samples under this fee structure.
(c) Facilities not currently on the public health submitter list for these programs that are requesting laboratory testing services should submit inquiries to the public health laboratory as not all testing services are available to all entities.
(d) The current Department of Health programs and specific tests affected by fee collection include:
(i) Immunization Program - tests for viral serology vaccine status;
(ii) Rheumatic Fever Control Program - group A strep antigen;
(iii) Sexually Transmitted Disease Program – Gonorrhea and/or Chlamydia tests for targeted private provider patients approved through the Gonorrhea and Chlamydia screening program;
(iv) Drinking Water Program - bacteriological testing; and
(v) Blood Alcohol Testing Program.
(a) Fees for testing shall be used by the public health laboratory to make purchases for reagents and supplies necessary to conduct analysis and comply with existing testing regulatory requirements as appropriated by the legislature.
(b) The public health laboratory may increase individual fee assessments by up to twenty percent (20%) without a rule change, if it is determined that the costs of laboratory testing necessitate such increases. The public health laboratory will notify all submitters at least ninety (90) days before any increase is effective. Increases greater than twenty percent (20%) will require a rule change.
Section 5. Fee Schedule for Services. The following fees shall apply for each test request submitted:
(a) Viral serology for vaccine status (IgG), each viral antigen (Rubella, Rubeola, Mumps or Chickenpox): Five Dollars ($5.00)
(b) Group A streptococcus antigen test: Five Dollars ($5.00)
(c) Chlamydia and Gonorrhea nucleic acid amplification collection kit: Twenty-five Dollars ($25.00)
(d) Drinking water coliform and E. coli screen (Colilert/Colisure): Five Dollars ($5.00)
(e) Blood alcohol collection kit: Nine Dollars and Fifty Cents ($9.50)
