CHAPTER 11

CERTIFICATE OF NEED REVIEW BOARD

Section 1. General.

(a) The Certificate of Need Review Board shall consist of seven members appointed by the governor. Four members shall be providers of health care, and three members shall be consumers.

(b) Board members shall serve three year terms, except when appointed to complete an unexpired term. Members whose terms expire shall hold office until appointment of their successors. The governor may replace a member who misses three consecutive meetings.

Section 2. Meetings.

(a) All Board meetings other than public meetings and contested case proceedings to consider an initial application shall be held at a place specified by the chairman.

(b) A simple majority shall constitute a quorum.

(c) All binding action shall require, at the very least, a majority vote of the quorum.
