Ambulance Personnel Criteria.
Section 1. Personnel Criteria. An ambulance, when used to provide ambulance service, shall have, at a minimum, the following:
(a) Ground ambulances shall be staffed with a driver and at least one (1) attendant certified as provided in Chapter V.
(b) Air ambulances. All ambulance service flights shall require at least one (1) attendant certified as provided in Chapter V and a flight crew in conformity with current Federal Aviation Administration Regulation 14 CFR 135.
(c) Any physician, osteopath, registered nurse, physician support person or nurse practitioner currently licensed in this state may function in the place of the certified attendant.
Section 2. Running Criteria. The driver of a ground ambulance shall comply with the following criteria.
(a) Emergency vehicle operation. The driver shall comply with all Wyoming traffic laws and regulations, including W.S. 315-928 and 31-5-952.
(b) Destination. In the absence of decisive factors to the contrary, the ambulance driver shall transport emergency patients to the closest accessible medical facility equipped, staffed and prepared to receive emergency cases and administer emergency medical care appropriate to the needs of the patient.
(c) Siren and approved warning light restrictions. Ground ambulance drivers shall not activate warning lights and use the siren except when responding to an emergency call, engaging in life-saving services at the scene or transporting emergency patients who are classified as 'emergent' or 'urgent' by the ambulance attendant on the state ambulance trip report form, as defined in Section 8 of this chapter.
Section 3. Communication Operations Criteria. Communications procedures, as published by the Division or its representative, shall be observed on all ambulance runs.
Section 4. Pilot Responsibilities. Pilots of air ambulances shall comply with the current Federal Aviation Administration Regulation 14 CFR 135, while providing air ambulance service.
Section 5. Trip Report Forms.
(a) An ambulance trip report is required for all patient trips. Each ambulance trip shall be recorded on a trip report form approved by the Division. The ambulance service shall send, as requested by the Division, copies of the completed trip reports to the Division. When requested, these shall be due within ten (10) days of the start of the next month.
Section 6. Inspection of Ambulance Trip Reports Records. The Division is authorized to inspect the records of any person operating an ambulance service to verify the information provided on the ambulance trip report.
Section 7. Patient Records. No person shall release a patient trip record without the patient's consent, except to a health care facility, a lawful court order, or the Division.
Section 8. Patient Classifications. For the purposes of these Rules and Regulations the following patient classification definitions shall be used.
(a) 'Emergent' means there is a serious threat to the life or limbs of the patient due to hypoxia or shock and the patient requires immediate transport and treatment to prevent death or permanent disability.
(b) 'Urgent' means there is a serious illness or injury to the patient which could allow the patient's condition to deteriorate into life threatening hypoxia or shock unless treatment is initiated at a medical facility within a reasonable length of time.
(c) 'Non-emergent' means a patient who has an injury or illness that is presently stable, which poses no present threat to life, and does not require the use of emergency vehicle warning devices.
(d) 'Medical emergency' or 'emergency' means patients who are classified as emergent or urgent and the use of emergency vehicle warning devices are deemed appropriate for the needs of the patient.
Section 9. Submission of Information on Claims. All political sub-division ambulances that come under the provisions of W.S. 16-4-201 (Wyoming Public Records Act) shall submit a copy of any claim filed against them within thirty (30) days of their receipt of such claim.
