Section 1. Authority. These regulations are promulgated by authority of W.S. 9-3-607(c) and W.S. 23-1-302.
Section 2. Definitions. For the purpose of this regulation, definitions will be as set forth in Title 9, Wyoming Statutes.
Section 3. Extension of Mandatory Retirement Age. This rule and regulation is promulgated pursuant to Section 9-3-607(c). Members of the Wyoming Highway Patrol and Game Warden Retirement System, who are currently employed by the Wyoming Game and Fish Department and who are scheduled to retire in 1991 may continue in service on a year-to-year basis pending a report from a task force assigned to study this issue more fully, and subject to the following conditions:
(a) On or before the employee's next birthdate, the Game and Fish Department will conduct a performance appraisal utilizing the State of Wyoming Performance Appraisal System. The minimum overall appraisal rating necessary to continue in service on a year to year basis will be 3.0, with no unsatisfactory rating on any single performance category. Should the employee fail to meet this minimum rating, the employment shall not be extended. The employee's right to an extension of time to increase the appraisal rating is eliminated for those employees who have attained the age of 55 and wish to extend their service on a year to year basis.
(b) Depending on the recommendations of the task force, this rule may be rescinded by the Commission.
