AND WYOMING LIVESTOCK BOARD CHAPTER XLI
Section 1. This regulation is promulgated by authority of W.S. 23-1-302 and 11-20-124.
Section 2. The Wyoming Game and Fish Commission and the Wyoming Livestock Board adopts the following regulation governing the designation of wild bison as wildlife. This regulation shall remain in effect until modified or rescinded by the Commission and Board.
Section 3. Individual wild bison and/or wild bison herds are hereby designated as wildlife as described in Subsections (a), (b) and (c) of this Section.
(a) When located upon federally owned lands within Shoshone and Teton National Forests in Park County, which shall be designated as the Absaroka Bison Herd.
(b) When located upon federally owned lands in Teton County except for that portion of Teton County south of U.S. Highway 89 and 189-191 south of Hoback Junction, which shall be designated as the Jackson Bison Herd.
(c) It shall be the responsibility of the owner of domestic bison to mark them in such a manner as to make them easily and visibly identifiable as domestic bison and bison which are not easily and visibly identifiable as domestic bison and which are not within the herd areas defined in subsection (a) or (b) hereof shall be presumed wildlife and shall be removed by the Commission or its designee as soon as practical after notification to the Commission of the sighting of such wild bison, subject to the following provisions:
(i) If the wild bison poses an immediate health threat to domestic livestock or an immediate threat to improvements on private or public lands, as either of the same shall be determined by the Wyoming Livestock Board or its duly designated representative, then such bison shall be removed by the Commission or its designee immediately; and
(ii) In the event that a landowner shall, by written declaration, preclude the Wyoming Game and Fish Commission from complying with subsection (c) hereof, the Game and Fish Commission shall report same to the Wyoming Livestock Board or its designated representative, and such bison then shall be presumed to be a domestic bison and disposition of the bison and regulation of the ownership of the bison shall be solely the responsibility of the Wyoming Livestock Board.
Section 4. Either the Wyoming Game and Fish Commission or the Wyoming Livestock Board may rescind these regulations upon 90 days written notice to the other agency.
