Section 1. Authority. These rules are promulgated by authority of W.S. 23-1-302(a)(vii), (x), (xiii) and (xxvi).
Section 2. Definitions. For the purpose of this regulation, definitions shall be as set forth in W.S. 23-1-101 and 23-1-102.
Section 3. Regulations and Effective Date. The Wyoming Game and Fish Department hereby adopts the following regulations concerning the issuance of scientific permits. These are new regulations superseding all Chapter XXXIII previously filed and shall remain in effect until modified or rescinded.
Section 4. Scientific Permits. Scientific permits may be issued by the director or assistant directors of the Wyoming Game and Fish Department to duly authorized agents of well-known institutions and to known persons of science for scientific or educational purposes under the following regulations:
a. To receive consideration, the applicant must submit a formal letter to the Wyoming Game and Fish Department, Cheyenne, Wyoming 82002, stating the name of the institution or entity for which he is an agent or the title or position said individual holds which would qualify him under the above stipulations. The formal application must present, in detail, a list of the species to be collected, the numbers to be collected, the specific area where collections are to be made and the methods of collection to be used. It must further state the purpose for which such collections will be made and the expected benefits to science, education or wildlife.
b. Each permit will bear the names of those individuals authorized to make collections, up to a maximum of three persons for any one permit, and will offer no protection to anyone other than those named on the permit.
c. The Department may require that permit holders notify the game warden, district game supervisor, or area fisheries biologist (when applicable) in the area where collections are to be made of the inclusive dates and specific area of activities prior to making any collection or conducting any activity involving manipulation of wildlife species.
d. Importation of wildlife or exotic species for a specified time period of less than ninety (90) days may be allowed for educational purposes under safeguards as may be required by the Department.
e. The successful applicant, regardless of any other names listed on the permit, will submit a written report to the Cheyenne office of the Wyoming Game and Fish Department, which will contain a record of the number of each species of wildlife taken, the locality where taken to the nearest township, range, section and 1/4 section, the age of animals taken when practical, a description of the habitat where taken, the disposition of the animal(s) (i.e. sacrificed, marked and released, or released), and any reports or papers written as a result of collections. Film companies must provide a written report of inclusive dates animals were filmed in the state. Such reports will be due no later than December 21 of the year of issuance.
Section 5. Violation of Regulation. Conviction for violation of this regulation or failure on the part of the permit applicant or holder to comply fully with this regulation may result in immediate revocation of said permit and refusal to issue any future permits.
