Section 1. Authority. This regulation is promulgated by authority of Wyoming Statutes § 23-1-302, § 23-1-303, § 16-3-103-(j) § 16-4-202 through § 16-4-204.
Section 2. Adoption of Uniform Rules. The Wyoming Game and Fish Commission thereby incorporates by reference the following uniform rules:
(a) Chapter 2 - Uniform Procedures, Fees, Costs, and Charges for Inspecting, Copying, and Producing Public Records adopted by the Department of Administration and Information and effective on September 6, 2016, found at: http://rules.wyo.gov.
(b) For these rules incorporated by reference:
(i) The Wyoming Game and Fish Commission has determined that incorporation of the full text of these rules would be cumbersome or inefficient given the length or nature of the rules;
(ii) The incorporation by reference does not include any later amendments or editions of the incorporated matter beyond the applicable date identified in subsection (a) of this section; and,
(iii) The incorporated rules are maintained at the Wyoming Game and Fish Department headquarters office in Cheyenne and are available for public inspection and copying at the same location.
Section 3. Definitions. In addition to the definitions set for in Title 23 of the Wyoming Statutes and Chapter 2, General Hunting Regulations, the Commission also adopts the following definitions for the purpose of this chapter:
(a) 'Geographic Information' means any location information collected by the Department or Commission related to the legal harvest of wildlife killed under a Department issued big game, furbearer hunting or trapping, game bird, small game, trophy game or wild bison license at a scale finer than a hunt area, or finer than a management area designation.
(b) 'Personally Identifiable Information' means a person's name, address, electronic mail address, date of birth, telephone number, driver's license number, social security number, passport number, sportsperson identification number, tax identification number or any part of the preceding information.
Section 4. Release of Information from Legally Taken Wildlife. W.S. § 16-4-203(d)(xx) and § 23-1-302(r) requires personally identifiable and geographic information associated with the legal taking of wildlife within the state to be for the sole use of the
Commission, Wyoming Game and Fish Department or an appropriate law enforcement office, and such information is not a public record for purposes of W.S. § 16-4-201 through § 16-4-205.
