CHAPTER II.-

APPLICATION OF THESE STANDARDS

'Section 1. General Information. These Water Well Minimum Construction Standards shall apply to any well commenced after June 30, 1971. It is the joint and several responsibility of the well owner and

1. the well driller - to see that these standards are met. These standards are retroactive when an existing ground water supply becomes polluted or becomes a health hazard. When extensive changes or repairs are made
2. to an existing well, they shall conform as near - as reasonably possible
3. to these standards.

Section 2. Unusual Conditions.

a, If, in any gig unique case, it appears that ground water can be protected against waste and contamination, both now and in the future, - without complying with - these Water Well Minimum Construction Standards, a waiver of some aspect of the standards be requested by applying in writing to the State Engineer. The variance can only be authorized by written order of the State Engineer. In order to prevent undue delay in instances where time is essential, the State Engineer may grant a waiver orally, upon oral request, provided that this request is followed, within 5 days, by the above written procedure:

b, If compliance with these Water Well Minimum Construction Standards still will not result in swell free from pollution, - or prevent a well - from being a source of subsurface leakage or contamination of - the ground water supply, the well driller must use his judgment in completing the well with any additional safeguards that he believes are - necessary to protect the ground water supply.

1. Section 3. - Wyoming Department of Environmental Quality - Water Quality Division - Water Supply Standards. Any well that is constructed to provide water to the either directly or indirectly, shall; in addition to meeting the standards set forth herein, meet all the requirements set forth - by the Department of Environmental Quality - Water Quality Division, Division of Health - Medical Services, minimum standards for private and semipublic water supplies. It is strongly urged that any individual domestic well also be constructed to meet the Wyoming Department of Environmental Quality - Water Quality Division - standards.
