(a) The State Banking Commissioner shall be the Administrator of the Wyoming Uniform Consumer Credit Code, W.S. 40-14-603. He shall be the policy-making and governing authority and be responsible for the enforcement of the Uniform Consumer Credit Code in the State of Wyoming.
(b) The Administrator shall appoint a Deputy Administrator. If the Office of the Administrator is vacant or if the Administrator is absent or unable to act, the Deputy Administrator shall be the Acting Administrator.
(c) Such other employees as are necessary to perform the duties imposed by law upon the Administrator of the Wyoming Uniform Consumer Credit Code shall be appointed by the Administrator.
(a) All papers, records and all other property of the Wyoming Uniform Consumer Credit Code shall be maintained and filed in the office of the Administrator.
(b) All communications shall be made to the Administrator of the Wyoming Uniform Consumer Credit Code and the records of such communications kept in said office.
The Administrator is hereby authorized to approve rate tables and rebate tables for use in this State, provided that such tables are not inconsistent with the tables or supplements thereto approved by the Board of Governors of the Federal Reserve System.
(a) An application shall be filed with the Division of Banking to acquire a license to make or take assignment of supervised loans or to engage in business as a sales finance company. This includes supervised lenders, pawnbrokers, post-dated check cashers and sales finance companies.
(b) Each application shall provide the following information:
(i) Name, address, EIN number or social security number, telephone and fax number of business.
(ii) Trade name, complete address and telephone number of all locations where person will be conducting business.
(iii) Name of person who will manage the location licensed.
(iv) Description of types of consumer credit transactions to be made.
(v) Type of ownership; corporation, partnership, sole proprietorship, limited liability company. Name, title, business and personal address, business and personal telephone number of all partners, officers and directors.
(vi) If a Wyoming corporation, date of incorporation.
(vii) If a foreign corporation, has applicant qualified to do business in Wyoming? Give complete details; date of incorporation, place of incorporation, date qualified in Wyoming, and name and address of designated agent in Wyoming for service of process.
(viii) List all other states in which a similar business is conducted or controlled by you. Include type of license and registration or permit number.
(ix) A true and correct statement of the financial condition of the applicant. Balance sheet figures given shall be current within thirty (30) days of application.
(x) Summary and description of resolution regarding any complaints filed against the business in the past five (5) years.
(xi) Summary of any formal sanctions imposed against the business as a matter of public record indicating but not limited to fine, reprimand, probation, censure, revocation, suspension, surrender or restriction. A copy of any disciplinary action shall be attached.
(xii) Names, addresses and occupations of three (3) professional references. One (1) reference shall be a bank reference, including the name of the banker.
(xiii) Notarized signature(s) of applicant. If a partnership, all partners must execute this form.
(c) Each completed application shall be submitted with a $150.00 application fee made payable to the Department of Audit.
(d) Each office or place of business shall be licensed separately and a $25.00 license fee shall be paid for each license required.
Any modification required to a license at the request of the business shall be submitted with a $25.00 modification fee made payable to the Department of Audit.
The annual renewal fee shall be $25.00, made payable to the Department of Audit, for each license held.
If any book, log, journal, document, record or information relevant and necessary to the examination or investigation is kept or maintained electronically, the business examined or investigated shall provide such data or access to data in an electronic format when requested by the administrator.
