Chapter 13: Statewide Branching

Section 1. Authority. The rules governing branch banking are adopted by authority of W.S. 13-2-702(f).
Section 2. Administration. The duties of the Department of Audit under W.S. 13-2-701 through 13-2-708 are administered by the state banking commissioner.
Section 3. Filing Fee. The fee for filing an application to establish a branch under W.S. 13-2-702 is seven hundred dollars ($700.00).
Section 4. Definition. The term 'well capitalized' shall be as defined by the Federal Deposit Insurance Corporation's regulations, Part 325.
Section 5. Additional Application Information. Each application shall contain the following information:
(i) Exact location of the proposed branch;
(ii) Certification of publication of notice of the application at least once in a newspaper of general circulation in the county in which the proposed branch will be located;
(iii) A certified statement discussing whether the new branch is located within the county where an existing branch resulted from a consolidation or merger of two or more banks authorized by W.S. 13-4-104;
(iv) Certification that the parent bank is well capitalized, as defined by these rules;
(v) Certification of compliance with the provisions of W.S. 13-3-201 relating to investment limitations in bank premises;
(vi) Certification that the establishment of the branch does not involve a prohibited insider transaction or management interlock;
(vii) A brief income and expense statement for the current bank utilizing the last filed call report data and a brief approximate income and expense statement for the bank and new branch for three (3) years;
(viii) The name(s) of proposed branch management;
(ix) Discussion of any planned variances in the parent bank’s lending policy, procedures or services at the proposed branch; and
(x) Such other information as the state banking commissioner may deem necessary to properly evaluate the branch bank operation to assure financial soundness and stability for protection of the public interest.
