Chapter 3: Application Proc for Financial Inst Charters

Section 1. General Procedure. The application procedure for any financial institution charter shall be generally governed by W.S. 13-2-201 through 13-2-215. Sections 543.2 and 545.14, Office of Thrift Supervision Regulations as amended are incorporated herein by reference to the extent that they do not conflict with Wyoming statutory provisions, or with these Rules and Regulations.
Section 2. Withdrawn Applications. If an application for a financial institution charter is withdrawn by the applicant at any time prior to a hearing on the application, the statutory application filing fee, minus the amount of any expense authorized by W.S. 13-2-208 and actually incurred, shall be refunded to the applicant.
Section 3. Application Forms. Official application forms required by the Board pursuant to W.S. 13-2-207 are attached to these Rules and Regulations as Appendixes, and are incorporated herein by reference. Proper completion of the required forms is a condition precedent to the Board's consideration of the application. Appended instructions and charter application forms are identified as follows: Appendix A, De Novo Bank; Appendix B, De Novo Domestic Savings and Loan Association; and Appendix C, Interim Bank Charters.
Section 4. Confidentiality.
(a) 'Financial Reports', shall be deemed confidential and not subject to public inspection.
(b) Each application received by the State Banking Commissioner shall consist of a Public File and a Confidential File.
(c) The Public File shall consist of an application with supporting data with the exception of material deemed by the State Banking Commissioner to be confidential, upon written application, such as trade secrets normally not available through commercial publication, subject to review by the State Banking Board and the provisions of the Wyoming Public Records Act, W.S. 16-4-201 through 16-4-205.
