Chapter 6: Procedures for Ranking Projects

Section 1. General. This Chapter establishes procedure to rank projects which are eligible for AML Funding.
Section 2. Project Eligibility and Ranking.
(a) The Department shall solicit proposals for projects to be considered for funding by the Program.
(b) Upon receipt of a proposed project, the Department shall conduct an initial evaluation of the proposal to determine eligibility in accordance with the requirements of Chapter VII of these regulations.
(c) All proposals eligible for consideration under Chapter VII shall be evaluated by the Abandoned Mine Land Advisory Board, created by Executive Order #1991-3 for purposes of assisting the Department with ranking the proposal for funding in accordance with Chapter VII, Section 6 of these regulations. The board's evaluation shall include consideration of public comment; for public facility projects, the interest of the public body supporting the project and the recommendations of the Program. Following analysis of all comments and recommendations, the board shall submit their recommendations and findings to the Department. the board's recommendations shall be advisory only.
