SANITARY RULES
Section 1. The use of barber shops as a living, dining or sleeping apartment is prohibited. No barber shop may be established in a residence except by permission of the State Board of Barber Examiners.
Section 2. No barber shop shall be located in connection with the following activities or structures unless there is a solid partition from floor to the ceiling which effectively physically separate such activities:
a. Living quarters.
b. Food service activities, bars or lounges, bakeries, grocery stores, pet shops, or garages.
c. The Board may, at its discretion, require the positive physical separation to separate a barber shop from other activities which in the Board's opinion creates or tends to create insanitary conditions either in the barber shop or the adjacent activity.
d. This amendment shall apply to all new barber shops upon adoption by the Board and compliance with state requirements. It shall also apply to all existing barber shops within two years of the date of adoption of this amendment.
Section 3. The walls, furniture and all other fixtures, and all other personal property of barber shops shall at all times be kept clean and in good repair; all jardiniers and cuspidors shall be thoroughly cleaned and sanitized a minimum of once each day. Floors shall be kept clean and hair clippings shall be removed from the floor whenever excess accumulation occurs.
Section 4. Every barber shop shall be equipped with hot and cold potable running water in sufficient quantity to provide ample amounts for adequate and complete cleaning of the shop and to provide for customer needs. Provision shall be made for approved waste disposal of liquid and solid wastes.
Section 5. All equipment, tools, brushes, and/or instruments shall be properly cleaned and sanitized following each use. Sanitizing or disinfecting solutions shall be registered with the Department of Agriculture, Pure Food and Drug Division, and shall be of a type approved by the Wyoming Department of Public Health and the Board of Barber Examiners. All towels utilized in the shop shall be laundered in an approved manner. A separate clean towel shall be used for each customer. Clean towels must be kept in a closed cabinet. Used towels put in a closed container.
Section 6. Prohibited equipment:
a. Common shaving brushes b. Finger bowls c. Lump alum (when used for styptic purposes) d. Sponges e. Powder puffs
Note: Common neck brushes are not recommended. When and where possible a different method of hair removal should be utilized. When the neck brush is so utilized, it must be kept clean at all times.
Section 7. All headrests of barber chairs shall be equipped with a paper dispenser which will provide a paper covering for the headrest. The paper covering shall be replaced following each usage. When not in use the headrest must be kept in a clean place, free of dust and dirt.
Section 8. No barber shall either shave or cut the hair of any person who by appearance has an infectious condition which might be spread to other patrons unless such person provides the needed tools and equipment for his individual use. Following the shaving or cutting the hair of a person described above all reasonable precautions shall be taken to properly clean and sanitize all multi-use equipment and fixtures which may have been contaminated in an approved manner.
Section 9. Every barber shall thoroughly cleanse his hands before accepting each new customer.
Section 10. No barber shall, to stop the flow of blood, use alum or other material unless the same be used as a powder and applied with a clean towel or in liquid form.
Section 11. No owner or manager of a barber shop shall permit any person suffering from a communicable disease or from any venereal disease in a communicable form to act as a barber in said shop. If venereal disease or any other contagious disease is suspected by reason of any discharge or account of conditions of skin, teeth, mouth, throat or any part of the body internal or external, or on account of any clinical symptom or symptoms, shall secure a health certificate from a medical doctor, showing that he is not affected with any communicable disease before he is allowed to go to work again in a barber shop as a barber.
Section 12. It shall be the duty of the head barber or manager of each barber shop, barber school or barber college to make certain that the barber or barber apprentice employed has a license to practice barbering in the State of Wyoming. Licenses and apprentice cards shall be posted in front of work stands where they may be easily seen. All licenses and apprentice cards must be renewed on or before the first day of July each year.
Section 13. No shop license, barber license, apprentice license or permit can be transferred. When a shop is sold or transferred to another person or persons the party holding license for the shop must send same to the Secretary of the Board in order to secure a new license for the same shop.
Section 14. Special inspections of new shops, shops changing from one location to another, or re-opening of old shops that have been closed three months or more will be: New shops $25.00. Change of location or re-opening $15.00.
Section 15. In the event a barber shop is found by the State Board of Barber Examiners to be in violation of these standards or rules and does, in the opinion of the Board, constitute a health hazard the Local and State Department of Health shall be notified. Such department shall thereupon investigate the complaint and submit their findings to the Board of Barber Examiners. If the findings indicate that practices or the physical condition of the shop do constitute a health hazard the Board shall institute immediate action to close the shop until corrections have been accomplished.
Section 16. An owner, proprietor or manager of a barber shop or college who contracts to teach anyone the barber trade and accepts money in payment or who sells or rents or offers to sell or rent such barber shop to one who has not a state license without first explaining the provisions of this chapter, and anyone who shall practice barbering without a license, aid or abet any person in violating the law or any sanitary rule or regulation shall be fined not less than ten nor more than one hundred dollars.
