Chapter 2: Min Stds for Employ as Peace Officers/Detention Officers/Dispatchers

(a) Every applicant for certification as a peace officer, and/or a detention officer for the State of Wyoming must meet the following standards and requirements established pursuant to W.S.9-1-704, et seq. and these rules before being employed.
(i) Be a United States citizen;
(ii) Be an adult;
(iii) Fingerprinting and search of local, state and National fingerprint files to determine whether the applicant has a criminal record (copies of responses must be sent to P.O.S.T.);
(iv) Shall not have been convicted by any state or federal government of a crime for which he could have been punished by imprisonment in a federal penitentiary or a state prison.
(v) Be the holder of a high school diploma or furnish evidence of successful completion of an examination indicating an equivalent achievement (proof must be sent to P.O.S.T.);
(vi) Be of good moral character as determined by a background investigation; the hiring agency shall complete a background investigation as defined by the commission of any applicant for employment as a peace officer and/or a detention officer before the applicant may be employed or begin training as a peace officer and/or detention officer;
(vii) Be free of any physical, emotional or mental conditions which might adversely affect his performance of duty as a peace officer and/or detention officer. Physical condition shall be evaluated by a person licensed to practice medicine. Emotional and mental conditions shall be evaluated by a licensed psychologist or psychiatrist;
(viii) Successfully pass an oral interview examination by the hiring agency.
(b) Every applicant for certification as a dispatcher for the state of Wyoming must meet the following proposed standards of the commission before being employed.
(i) Be an adult;
(ii) Fingerprinting and search of local, state and national fingerprint files to determine if the applicant has a criminal record (Copy of responses must be sent to P.O.S.T.);
(iii) Shall not have been convicted by any state or federal government of a crime for which he could have been punished by imprisonment in a federal penitentiary or a state prison.
(iv) Be the holder of a high school diploma or furnish evidence of successful completion of an examination indicating an equivalent achievement (proof must be sent to P.O.S.T.);
(v) Be of good moral character as determined by a background investigation;
(vi) Must successfully pass a personal interview by the hiring agency.
(c) Every applicant who is appointed as a peace officer, detention officer, or dispatcher, in or for the State of Wyoming, must submit to Peace Officers Standards & Training Commission an Initial Employment Form or Re-entry Form within fifteen (15) days of the appointment. If the applicant meets the minimum standards, the director shall issue a temporary certificate within fifteen (15) days of the receiving of the Initial Employment Form or Re-entry Form by the commission.
(d) Every applicant considered for employment as a peace officer, detention officer or dispatcher should complete a personal history statement form for the purpose of providing information for a background investigation.
(e) The following minimum standards for the background investigation have been established by the commission and must be ensured by the hiring agency prior to employing an applicant as a peace officer, detention officer or dispatcher.
(i) Check current drug and alcohol abuse.
(ii) Interview with spouse.
(iii) Check personal references.
(iv) Employment history check.
(v) School records check.
(vi) Military records check.
(vii) Criminal record check. (Check must be made in every state and city where applicant has resided).
(viii) Driving record check.
(ix) Present employer reference check. (This should include a check with the applicant's immediate supervisor and peers.)
(x) DCI & FBI fingerprint files shall be searched to determine if applicant has a criminal record.
(xi) Credit check.
(f) The standards set forth in W.S.9-1-704, concerning peace officer and/or detention officer qualifications shall be deemed minimum standards and in no way preclude counties, cities or towns from establishing higher employment standards.
(g) Any person who has been appointed as a full-time peace officer and/or detention officer for any law enforcement unit in or for the State of Wyoming shall forfeit his position unless he has previously satisfactorily completed, or within one (1) year of the date of appointment, satisfactorily completes a commission approved peace officer and/or detention officer basic training program required for his respective certification.
(h) Any person appointed as a dispatcher on a full or part time basis shall forfeit his position unless within two years from the date of employment he is awarded a certificate by the commission certifying successful completion of a commission approved dispatcher basic training program.
(i) Every person who is appointed as a part-time or reserve peace officer shall forfeit his position unless within two (2) years from the date of his appointment he is awarded a certificate by the director attesting that he satisfactorily completed a commission approved peace officer basic training program.
(j) The certificate shall remain the responsibility of the commission and the commission shall have the power to revoke or recall any certificate as provided by these rules.
(k) Certification shall be deemed inactive if a peace officer and/or detention officer is no longer within a Wyoming law enforcement agency.
(l) Dispatcher certification shall be deemed inactive if a dispatcher is no longer within a law enforcement agency, a fire service or a licensed ambulance service.
