Section 1. Statutory Authority. Pursuant to Section 7-19-105, W.S. 1977 (June, 1987 replacement), the Division of Criminal Investigation, Office of the Attorney General hereby promulgates these rules.
Section 2. Purpose. The purpose of these rules is to implement the legislative mandate to:
(a) Promulgate standards and procedures to ensure the security and privacy of criminal history information and to ensure that such information is used only for criminal justice and other lawful purposes;
(b) Promulgate standards and procedures, in conformance with the Wyoming Criminal History Record Act, relating to access to and dissemination of criminal history record information, research, system security, record completeness and accuracy, training, intrastate and interstate exchanges, user agreements, audits and procedures for review and challenge of records;
(c) Establish fees and acceptable forms of payment for dissemination of criminal history record information to non-criminal justice agencies;
(d) Establish audit practices for audit of information at the central repository;
(e) Establish sanctions to be imposed upon contributors and recipients of criminal history record information for non-compliance with these rules or the Wyoming Criminal History Record Act.
Section 3. Statutory Changes. Whenever these rules refer to Wyoming statutes and these statutes are renumbered or amended, these rules shall be interpreted to reflect such changes.
