Chapter 2: Services for Disabled or Incapacitated Miners

(a) To be eligible for services or benefits provided to disabled or incapacitated miners by the Board pursuant to Wyo. Stat. § 30-6-102 (b)(i) an individual must:
(i) Be a resident of Wyoming. This requirement is waived if the individual sustained a disabling injury or illness as a result of employment as a miner, provided that the injury or illness was compensable under the Wyoming Workers Compensation Act, Social Security Disability Benefits have been awarded and/or there is documented a medical probability that the disabling injury or illness is attributable to work as a miner.
(ii) Be or have been employed as a miner.
(iii) Have a disabling or incapacitating injury or illness which is due to labor in the mining industry.
(iv) Be in need of services provided by the Board.
(b) The following may be submitted as evidence of an individual's eligibility for services:
(i) Residency—Deed, lease or Real Estate Sales Contract; property tax statements; utility bills; voter registration; attestation by third parties; any other verifiable information. A general hospital stay does not qualify as time toward meeting the residency period.
(ii) Employment as a miner—Employment records; proof of eligibility for mine related disability benefits; attestation by third parties with knowledge of the individuals employment as a miner; any other verifiable information.
(iii) Disability or incapacity due to labor in the mining industry—Proof of eligibility for mine related disability benefits such as a determination letter, Black Lung card, mine records or similar documentation; Physician's written statement or other documents establishing the medical probability the individual suffers such a disability as a result of employment as a miner; any other verifiable information.
(iv) Need for services—Physician's written statement or any other verifiable information.
