Section 1. License Required. No person shall operate a public pool in this state without a license granted by the Division.
Section 2. Approval. The Division shall grant a license to a person who:
(a) Operates a pool in compliance with these regulations; and (b) Completes an application form provided by the Division.
Section 3. Inspections, Suspension, Revocation and Summary Suspension.
(a) Inspection Frequency: An inspection of each pool/bathing place shall be performed twice each year if operated on a 120 day or more basis. All pool/bathing places operated less than 120 days per year shall be inspected at least once (1) during each operational period.
(b) Access: Representatives of the Division, after proper identification, shall be permitted to enter any pool/bathing place at any reasonable time for the purpose of making inspections to determine compliance with these regulations. Representatives shall be permitted to examine records of the establishment.
(c) Inspection Reports: Written reports shall be made of each pool inspected and a copy of the report shall be provided to the operator with a date for correction of any non-compliant condition, if any.
(d) Enforcement and Penalty: The completed inspection report shall constitute a notice of violations found and shall specify the period of time in which corrections of violations shall be accomplished. If all corrections are not completed by the due date specified, the Division may move to suspend or revoke as provided in subparagraphs e, f, g, h, i, and j.
(e) A license may be suspended or revoked by the Division for non-compliance with these regulations.
(f) The Division shall notify the operator, in writing, as to any violations of these regulations, and the action to suspend or revoke, no less than thirty (30) days before the suspension or revocation becomes effective,
(g) The suspension or revocation shall become effective thirty (30) days from the date of the operator's receipt of the written notice unless the operator requests a hearing within that time, or shows compliance with all lawful requirements for the retention of the license.
(h) A license may summarily suspended if the Division determines that a condition exists that is an imminent hazard to the public health.
(i) The Division shall include, within its suspension order, a finding to the effect that such an emergency action is imperatively required and the violations causing the emergency, and that there are no other less drastic alternatives.
(j) The operator shall have a right to a postsuspension hearing. The operator shall request a hearing within five (5) days of the suspension. The Division shall hold a hearing, if requested, within ten (10) days of the suspension.
(k) All hearings shall be conducted in accordance with Wyoming Administrative Procedure Act, W.S. 1977, 16-3-101 et. seq.
(a) Operators of public pools shall be thoroughly knowledgeable on good practices of pool operation and with the laws and rules pertaining to public pools. The operator shall keep all parts and facilities of the public pools and bathhouses clean, in good repair and free of safety hazards. If, at any time, testing indicates that the pool water does not comply with the requirements for clarity, residual free chlorine, ph or temperature (spas and flotation tanks) or chemical or bacteriological quality, the operator shall immediately close the pool to the public until these requirements are met.
(b) Operators of public pools shall keep records pertaining to the operation and maintenance of the pool they operate on forms prescribed by the Division.
(i) Operator records shall be maintained daily during periods when the pool is open, and shall be retained by the operator and made available to the Division upon request. All such records shall be retained for a period of 12 months.
(ii) Operator records shall include at least the following: (A) Bather load at time of water quality tests. (B) Amounts of chemicals added to the pool. (C) Results of the tests described in Pool Water Quality, Section 8(a) of this Chapter. (D) Date and time of filter backwash. (E) Dates the pool was emptied and/or cleaned. (F) Periods of recirculation equipment operation and/or malfunction and repair.
(iii) Operators of public pools shall collect and submit bacteriological and/or chemical samples as determined by the Division in containers provided by the Division at a frequency of at least one (1) bacteriological sample twice a month and one (1) chemical sample every three (3) years.
Section 5. bet.
(a) Lifeguards:
(i) An operator of a general-use public pool shall have approximately one lifeguard per 40 bathers or fraction thereof during operating hours.
(ii) An operator of a limited-use public pool may post a sign reading "No Lifeguard on Duty" in lieu of lifeguards.
(b) Lifeguards, pool operators or managers shall enforce the following rules at all public pools.
(i) Nonswimmers and children under 8 years of age shall not use the pool unless a lifeguard is present, or in a limited-use pool, a responsible person at least nineteen is years of age is present.
(ii) No person suffering from a communicable disease transmittable via water or under the influence of an intoxicating liquor or drug shall use the pool.
(iii) No person shall take food or drink inside the pool enclosure except in areas specifically designated for such use as described in Food Services, Section 8 of this Chapter.
(iv) No person shall bring, throw or carry food, drink, smoking material, trash, debris or any other foreign substances into the pool.
(v) No person shall run or engage in horseplay in or around a public pool.
(vi) The hydrotherapy pump and air blower in spa pools shall be connected to a maximum 15 minute time switch located no closer than 10 feet (3m) from the spa water's edge.
(vii) Recirculation pumps and heater thermostat switches shall be inaccessible to bathers.
(viii) A telephone shall be available on the premises and an emergency rescue phone number shall be posted in view of the telephone.
(c) The person operating any public swimming pool shall report, in writing on forms provided by the Division, any drowning, other death or serious injury occurring on the pool's premises. Reports shall be submitted within seven days of the occurrence.
(a) A public pool operator shall post a sign at the entrance to the pool enclosure stating the following information:
(i) No person suffering from a communicable disease transmittable via water or under the influence of an intoxicating liquor or drug shall use the pool.
(ii) All nonswimmers and children under 8 years of age shall be accompanied by a responsible adult observer.
(iii) No person shall run or engage in horseplay in or around the pool.
(iv) Elderly persons and those suffering from heart disease, diabetes or high blood pressure should consult their physician before using the spa pool.
(v) Persons using prescription medications should consult their physician before using the pool.
(vi) Pregnant women should not use the spa pool without consulting their physician.
(vii) Persons should spend no more than 15 minutes in the spa at any one session.
(viii) The emergency rescue phone number.
(b) The doors to all rooms in which a chlorine gas feeder is located or a cylinder of compressed chlorine gas is located or stored shall be labeled 'DANGER - CHLORINE GAS' in letters at least four inches (10cm) in height and of an orange color on a green background.
(c) Signs shall be a minimum of 18 inches X 24 inches with letters at least one-half inch in height with the exception of subsection (b) of this Section.
(a) Water supplied at public swimming pools shall comply with the National Primary Drinking Water Regulations.
(b) There shall be no cross-connection between the pool water, recirculation system or backwash system and the domestic water supply or sewer system.
(a) Water in public pools shall be maintained with water quality parameters within the following limits:

NTU = Nephelometric Turbidity Unit, or such that a standard two inch (5cm) diameter clarity disc that is divided into alternate black and red quadrants is clearly visible and the separate colors discernible through 15 feet (4.57m) of water.
As measured by the membrane filter technique using the Standard Methods for the Examination of Water and Wastewater, 1980 ed.
Depends on chemicals in make-up water, type of chlorine used and lining of the pool.
(b) Testing equipment:
(i) All public pools shall have functional test kits or equipment for measuring the ph, free chlorine (bromine or iodine), total alkalinity and cyanuric acid (if used).
(ii) Test kits for measuring free chlorine shall use DPD as the reagent.
(iii) A thermometer that is accurate (+2°F) shall be provided at spa pools and flotation tanks.
(c) Pool operators shall test and record the parameters described in (a)(i), with the following minimum frequencies during periods when the pool is open for use:
(i) ph - spa pools and flotation tanks every hour there is a bather load all other pools every four hours.
(ii) Disinfectant - spa pools and flotation tanks, every hour All other pools, every four (4) hours. Continuous reading devices shall satisfy requirements Section 8 (b)(i) and (ii) if such devices record in ppm of disinfectant.
(iii) Temperature - spa pools and flotation tanks, every hour there is a bather load.
(iv) Total alkalinity - weekly.
(v) Turbidity - daily.
(vi) Cyanuric acid - monthly (if used).
(d) Spa pools shall be drained and refilled with fresh water at least once every 30 days.
Section 9. Food Service. Food or drink shall be permitted only in designated areas away from the pool. Food may be permitted in a spectator area located near the pool provided the pool deck area remains clear. No glass, plastic, or metal containers shall be allowed near the pool. Food service facilities shall comply with the Wyoming Food Service Regulations, 1982.
(a) The public pool operator shall not allow spectators and visitors to use restrooms provided for swimmers and bathers.
(b) Visitors and spectators shall be allowed to enter the pool enclosure only if they are confined to a distinct area not used by swimmers and bathers.
Section 11. Vacuum Cleaner. The public pool operator shall maintain an approved vacuum capable of effectively removing settled material from the pool bottom.
