CHAPTER II
APPROVAL OF CONSTRUCTION OR ALTERATION
Section 1. Certificate of Approval Required.
(a) No person shall construct or alter a public pool or bathhouse or alter an existing pool or bathhouse in areas relating to pool water, filtration, disinfection or other significant items of health without:
- (i) Submitting complete plans, specifications and other information to the Division; and
- (ii) Receiving written approval or written conditional approval from the Division.
(b) No person shall deviate from the approved or conditionally approved plans and specifications during the construction or alteration of a facility described in ~i) above without written approval from the Division.
Section 2. Contents of Plans.
(a) Plans shall be drawn to scale and shall include:
- (i) One plan view.
- (ii) One longitudinal section.
- (iii) One transverse section through the main drain.
(iv) One overall plan showing the pool in relation to other facilities in the area. (This plan may be combined with (i) and (vi) of this Section.)
- (v) One detailed view of the equipment room layout.
- (vi) One vicinity map with a legal description of the pool location.
(vii) One piping schematic showing piping, pipe size, inlets, main drains, skimmers, gutter outlets, vacuum fittings and all other appurtenances connected to the pool piping system.
(b) Plan notes such as "fence by owner" or "deck to be under separate contract" shall not be acceptable as a substitute for
Section 3. Application Form. The applicant shall complete an application form provided by the Division. The application shall include the:
- (a) Legal address of the facility.
- (b) Location of the facility if different from the 1-1 address.
- (c) Owner's name, address and telephone number.
- (d) Surface area of the pool.
- (e) Pool volume, turn-over time, flow rate, filter rate/unit area, type of filter and total system head loss.
- (f) The type of facility (e.g., resort, food).
- (g) Manufacturer, make and model numbers of the pump, filter and automatic chemical feed apparatus, filter head loss and pump curve showing design flow.
- (h) Source of water used at the pool.
- (i) Means of disposing wastewater according to law.
Section 4. Approval of Final Project. The Division shall inspect the final project and determine whether the pool meets the design and equipment requirements of Chapter III of these regulations. If the Division finds that the pool meets the design requirements of Chapter III, it shall issue a license.
- (a) Conditional approval to the final project may be issued provided:
- (i) pre-opening inspection has revealed substantial compliance with the regulations but with certain nonlife threatening items not completed, or
- (ii) an inspection by the Division cannot be made within thirty (30) days from the time a written request for inspection is made. A conditional approval shall allow the operator to open the pool to the public and operate utilizing all guidelines and safeguards for such pools.
