CHAPTER I
Section 1. Authority. These rules are promulgated pursuant to the Wyoming Administrative Procedure Act, W.S. 16-3-101 through 16-3-115, W.S. 35-1-229 and 35-1-240(a)(xv).
Section 2. Purpose. These regulations have been adopted to establish design, equipment and operational standards for public swimming pools, plunge pools, wading pools, wee pools, flowthrough pools, flotation tanks, flumes, slides, bathhouses.
Section 3. Definitions. As used in these regulations:
(a) 'Bathhouse' means a structure that contains dressing rooms, showers and toilet facilities for use with an adjacent public pool.
(b) 'Division' means the Division of Health and Medical Services, Department of Health and Social Services, Cheyenne, WY, or the delegate local health department.
(c) 'Flotation tank' means a tank designed for body immersion in skin-temperature salt water.
(d) 'Flow-through pool' means an artificial or partially-artificial pool that depends on the natural flow of water through it to maintain adequate water quality.
(e) 'Flume' means a slide or tube greater than twelve feet (3.66m) in height above the pool water surface.
(f) 'General-use public pool' means any pool other than limited-use public pools. Public pools operated in conjunction with a companion facility but not limited to use of the residents, patrons or members of the companion facility are general-use pools.
(g) 'Health officer' means the administrator of the Division of Health and Medical Services of the Wyoming Department of Health and Social Services, his officially designated representative, his designee appointed pursuant to W.S. 35-1-227 or 35-1-306, or the person appointed as health officer pursuant to W.S. 35-1-305.
(h) 'Lifeguard' means a currently certified Red Cross Advanced Lifesaver, YMCA Senior Lifesaver or a person having equivalent certification acceptable to the Division.
(i) 'Limited-use public pool' means any pool located at and operated in connection with a companion facility such as a residential housing facility having four or more living units, travelers' accommodation, mobile home park, recreation park, boarding school, organizational camp, dude ranch, club or association where use of the pool is limited to residents, patrons or members of the companion facility.
(j) 'Person' includes, but is not limited to, municipalities, recreation districts, counties, state agencies, individuals, corporations, partnerships, enterprises or associations.
(k) 'Pool' means an artificial structure containing water used for swimming, bathing, diving, surfing, wading or a similar use.
(l) 'Private-use pool' means any constructed pool, permanent or portable, which is intended for noncommercial Use as a swimming pool by not over three owner families ~d their guests, and which is over twenty-four inches (24') in depth and (a) has a surface area exceeding 250 square feet, or (b) a volume over 3,250 gallons.
(m) 'Public pool' means a pool that is open to the public or a segment of the public.
(n) 'Plunge pool' means the pool located at the lower end of a flume.
(o) 'Slide' means a slide used in conjunction with a pool 12 feet (3.66m) or less in height above the pool water surface.
(p) 'Spa pool' means any pool primarily designed to direct water or air-enriched water under pressure onto a bathers body to produce a relaxing or therapeutic effect.
(q) 'Swimming pool' means a body of water, other than a natural swimming area, maintained exclusively for swimming, recreative bathing or wading, and includes appurtenances used in connection with the swimming pool.
(r) 'Wading pool' means a pool that contains water two feet (.6m) or less in depth.
(s) 'Wave pool' means a pool with artificial woes designed to be used for body or board surfing.
Section 4. Adoption by Reference. Outside standards, listings and publications referred to in these Sections are by reference made a part of these rules as they relate to sanitation. The references include:
(a) Uniform Plumbing Code, International Association of the Plumbing and Mechanical Official(s), 1982.
(b) Uniform Building Code, International Conference of Building Official(s), 1982.
(c) Wyoming State Electrical Code.
(d) U.S. Consumer Product Safety Commission, Safety Standards for Swimming Pool Slides, 1976.
(e) National Sanitation Foundation (NSF) Standard *14 for Plastic Piping System Components and Related Material~.
(f) National Sanitation Foundation (NSF) Standard *-O, Circulation System Components, 1979.
(g) Standard Methods for Examination of Water ~d Wastewater, 1980 ed.
(a) These regulations shall apply to any person who owns, operates or manages a public pool in this state.
(b) These regulations shall not apply to private-use pools.
(c) Pools that were in public use before the adoption of these rules shall comply with all of these regulations except Section 3 of Chapter III, and items related to the pool shell, Section 4, Chapter III and Section 18, Chapter III deck widths.
(a) The Division may grant a variance from these regulations if it finds that:
(i) Compliance would be highly burdensome or impractical due to special circumstances or unforeseen conditions; and
(ii) The public's health and safety will not be injured or impaired to any degree.
(b) A person desiring to obtain a variance from th2se regulations shall send a written request to the Division.
(c) A variance is valid only if it is issued in writing from the Division following a proper written request from, an applicant.
