Chapter 62: Rules Pertaining to Hemp Sampling, Analysis, and Disposal Verification Fees

Emergency rules are in effect no longer than 120 days after filing with the Registrar of Rules.
Section 1. Authority. These rules are written in accordance with the authority provided in Wyoming Statutes 11-51-104(a) and 11-51-105.
Section 2. Definitions. Any applicable term defined in W.S. 11-51-101 shall have the same meaning throughout these rules.
(a) “Analysis” means the process that the Wyoming Department of Agriculture Analytical Services Laboratory conducts to determine the THC concentration level of a sample of Cannabis. (b) “Cannabis” means a genus of flowering plants in the family Cannabaceae of which Cannabis sativa is a species, and Cannabis indica and Cannabis ruderalis are subspecies thereof. For the purposes of these rules, Cannabis refers to any form of the plant in which the delta-9 tetrahydrocannabinol concentration on a dry weight basis has not yet been determined.
(a) The Department will assess the following fees:
(i) $200 per sampling conducted by the Department in accordance with the Department’s Chapter 61 Rules Pertaining to Hemp. (ii) $200 per analysis conducted by the Department. (iii) $250 for verification of effective disposal of Cannabis or Cannabis products in accordance with Section 11 of the Department’s Chapter 61 Rules Pertaining to Hemp.
