W. Va. Code § 9-8-6

Case review.

  1. (a) If the information obtained from the review provided in this article does not result in the department finding a discrepancy or change in an applicant’s or recipient’s circumstances affecting eligibility, the department shall not take any further action and shall continue processing the application.
  2. (b) If the review results in a discrepancy, the department shall promptly redetermine eligibility.
