1. (1) Hearings are public, unless a protective order is issued under WAC 10-08-200(7), and are limited to the portions of a complaint found to state a cause of action under WAC 391-45-110.

   1. (a) The complainant is responsible for the presentation of its case and has the burden of proof.
   2. (b) The respondent is responsible for the presentation of its defense and has the burden of proof as to any affirmative defenses.
2. (2) Once a hearing has been declared closed, it may be reopened only upon the timely motion of a party that discovered new evidence which could not with reasonable diligence have been discovered and produced at the hearing.
