1. (1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.

2. (2) An actor commits wrongful commencement of an action in justice court if the actor:

   1. (a) is:

      1. (i) a party to a suit or a proceeding; or
      2. (ii) an agent or attorney for a party to a suit or proceeding; and
   2. (b) except as provided in Section 78A-7-105 or 78A-7-106, knowingly commences, prosecutes, or maintains an action, suit, or proceeding in a justice court.
3. (3) A violation of Subsection (2) is a class B misdemeanor.
