1. (1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.

2. (2) An actor commits refusal to comply with an order to evacuate or order issued in a local or state emergency if the actor:

   1. (a) receives notice of:

      1. (i) an order to evacuate issued under Title 53, Chapter 2a, Emergency Management Act; or

      2. (ii) an order issued:

         1. (A) by the governor in a state of an emergency under Section 53-2a-204; or
         2. (B) by a chief executive officer in a local emergency under Section 53-2a-205; and
   2. (b) refuses to comply with the order described in Subsection (2)(a).
3. (3) A violation of Subsection (2) is a class B misdemeanor.
