(4) The director, with the concurrence of the board, may make distributions from the fund for the following purposes:

1. (a) education and training:

   1. (i) that covers:

      1. (A) the requirements of this title;
      2. (B) division rules related to this title;
      3. (C) the requirements of Chapter 37, Utah Controlled Substances Act; and
      4. (D) any division rules related to Chapter 37, Utah Controlled Substances Act; and

   2. (ii) that the division makes available for:

      1. (A) physicians and surgeons;
      2. (B) osteopathic physicians and surgeons;
      3. (C) naturopathic physicians;
      4. (D) division staff; and
      5. (E) members of the board; and

2. (b) enforcement of Chapter 67, Utah Medical Practice Act, Chapter 68, Utah Osteopathic Medical Practice Act, and Chapter 71, Naturopathic Physician Practice Act, by:

   1. (i) investigating unprofessional or unlawful conduct;
   2. (ii) obtaining legal representation for the division to bring an action against a person engaging in unprofessional or unlawful conduct; and
   3. (iii) monitoring compliance of renewal requirements.
