As used in this chapter, "unlawful conduct" includes:

1. (1) practice of the following unless licensed in the appropriate classification or exempted from licensure under this title:

   1. (a) mental health therapy;
   2. (b) clinical social work;
   3. (c) certified social work;
   4. (d) marriage and family therapy;
   5. (e) clinical mental health counselor;
   6. (f) practice as a social service worker; or
   7. (g) substance use disorder counselor;
2. (2) practice of mental health therapy by a licensed psychologist who has not acceptably documented to the division the licensed psychologist's completion of the supervised training in mental health therapy required under Subsection 58-61-304(1)(f); or

3. (3) representing oneself as, or using the title of, the following unless currently licensed in a license classification under this title:

   1. (a) psychiatrist;
   2. (b) psychotherapist;
   3. (c) registered psychiatric mental health nurse specialist;
   4. (d) mental health therapist;
   5. (e) clinical social worker;
   6. (f) certified social worker;
   7. (g) marriage and family therapist;
   8. (h) clinical mental health counselor;
   9. (i) clinical hypnotist;
   10. (j) social service worker;
   11. (k) substance use disorder counselor;
   12. (l) associate clinical mental health counselor; or
   13. (m) associate marriage and family therapist.
