1. (1)

   1. (a) A person engaged in a construction trade or acting as a contractor shall obtain a license under this chapter before performing work unless exempt from licensure under Section 58-1-307 or 58-55-110.

   2. (b) The only licenses required for a licensee to engage in a trade regulated by this chapter are:

      1. (i) a license issued under this chapter; and
      2. (ii) a business license from the local jurisdiction where the licensee maintains the licensee's principal place of business.

   3. (c) The state or a political subdivision may not impose additional requirements on a licensee to do business except:

      1. (i) contract prequalification procedures a state agency requires; or
      2. (ii) the payment of fees a local jurisdiction makes as a condition for doing business.

2. (2)

   1. (a) To obtain a license, an applicant shall file an application that includes payment of a fee the division determines in accordance with Section 63J-1-504.
   2. (b) An applicant may apply for a license for one or more licenses issued in accordance with this chapter.
   3. (c) The division shall issue each license for which the applicant applies and qualifies.
   4. (d) The applicant shall submit a separate application and fee for each license.

3. (3) With the concurrence of the director and in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the commission may makes rules to further define the scope of work for:

   1. (a) a general electrical contractor as defined in Section 58-55-202;
   2. (b) a general plumbing contractor as defined in Section 58-55-202;
   3. (c) an HVAC contractor as defined in Section 58-55-202;
   4. (d) a residential electrical contractor as defined in Section 58-55-202; and
   5. (e) a residential plumbing contractor as defined in Section 58-55-202.
