1. (1) There is created the Electricians and Plumbers Licensing Board consisting of the following members:

   1. (a) three individuals:

      1. (i) licensed as master plumbers as defined in Section 58-55-401, or a journeyman plumber as defined in Section 58-55-401; and
      2. (ii) of whom at least one represents a union organization and at least one has no union affiliation;

   2. (b) two individuals:

      1. (i) who are each a qualifier for separate licensed plumbing contractors as defined in Section 58-55-202; and
      2. (ii) of whom one represents a union organization and one has no union affiliation;

   3. (c) three individuals:

      1. (i) licensed as master electricians as defined in Section 58-55-301, or as journeyman electricians as defined in Section 58-55-301; and
      2. (ii) of whom at least one represents a union organization and at least one has no union affiliation;

   4. (d) two individuals:

      1. (i) who each are a qualifier for separate licensed electrical contractors as defined in Section 58-55-202; and
      2. (ii) of whom one represents a union organization and one has no union affiliation; and
   5. (e) one individual who is a member of the general public and who has never been licensed in a construction trade.

2. (2) The duties, functions, and responsibilities of the board include:

   1. (a) recommending to the commission appropriate rules;
   2. (b) recommending to the commission policy and budgetary matters;
   3. (c) assisting the commission in fulfilling the commission's duties; and
   4. (d) acting as presiding officer in conducting a hearing associated with an adjudicative proceeding and issuing recommended orders.
