1. (1) There is created the Board of Massage Therapy and Acupuncture consisting of:

   1. (a) four massage therapists;
   2. (b) two licensed acupuncturists as defined in Section 58-72-102; and
   3. (c) one member of the general public.
2. (2) The board shall be appointed and serve in accordance with Section 58-1-201.

3. (3)

   1. (a) The board shall perform the duties and responsibilities described in Sections 58-1-202 and 58-1-203 with respect to this chapter and Chapter 72, Acupuncture Licensing Act.

   2. (b) In addition, the board shall designate one of the board's members on a permanent or rotating basis to:

      1. (i) assist the division in reviewing complaints concerning the conduct of an individual licensed under this chapter or Chapter 72, Acupuncture Licensing Act; and
      2. (ii) advise the division in the division's investigation of these complaints.
4. (4) A board member who has, under Subsection (3), reviewed a complaint or advised in the complaint's investigation may be disqualified from participating with the board when the board serves as a presiding officer in an adjudicative proceeding concerning the complaint.
