1. (1) A person may not provide an official seal to an individual claiming to be a notary, unless the individual presents a copy of the individual's notarial commission, attached to a notarized declaration substantially as follows:Application for Notary's Official SealI, __________________ (name of individual requesting seal), declare that I am a notary public duly commissioned by the state of Utah with a commission starting date of __________, a commission expiration date of_______________, and a commission number of ___________. As evidence, I attach to this statement a copy of my commission.

2. (2)

   1. (a) Except as provided in Subsection (2)(b), an individual may not create, obtain, or possess an electronic seal unless:

      1. (i) the individual is a notary; and
      2. (ii) the electronic seal complies with the standards established by rule under Subsection 46-1-3.7(1)(d).
   2. (b) A person is not guilty of a violation of Subsection (2)(a) if the person is a business that creates, obtains, or possesses an electronic seal for the sole purpose of providing the electronic seal to a certified notary.
3. (3) A person who provides, creates, obtains, or possesses an official seal in violation of this section is guilty of a class B misdemeanor.
