1. (1) The division shall:

   1. (a) exercise the division's enforcement powers in accordance with Chapter 2, Division of Consumer Protection, and this chapter;

   2. (b) make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to:

      1. (i) establish the content of a registration statement required under this chapter;
      2. (ii) establish a process for reviewing and responding to complaints the division receives in accordance with this chapter; and
      3. (iii) establish a fee in accordance with Section 63J-1-504 for filing a registration statement;
   3. (c) issue a registration certificate or state authorization certificate to a postsecondary school upon the division's receipt and approval of a qualifying registration statement;

   4. (d) maintain and publish a list of postsecondary schools to which the division has issued a:

      1. (i) registration certificate; or
      2. (ii) state authorization certificate; and
   5. (e) deposit fees established in accordance with Subsection (1)(b)(iii), and collected in accordance with this chapter into the Commerce Service Account created in Section 13-1-2.

2. (2) The division may:

   1. (a) accept a copy of an educational credential from a postsecondary school that ceases operation;
   2. (b) charge a reasonable fee for providing a copy of an educational credential;
   3. (c) upon request, provide a letter confirming that a postsecondary school is exempt from registration in accordance with Section 13-34-111; and
   4. (d) negotiate and enter into an interstate reciprocity agreement with another state, if in the judgment of the division, the agreement is consistent with the purposes of this chapter.
