1. (1)(a) A long-term care insurance shopper's guide, in the format developed by the NAIC, shall be provided to a prospective applicant.

   1. (b) A producer shall deliver the shopper's guide before the presentation of an application or enrollment form.
   2. (c) For a direct response solicitation, the shopper's guide must be presented in conjunction with an application or enrollment form.

2. (2) A life insurance policy or rider that provides incidental long-term care benefits:

   1. (a) is not required to furnish the shopper's guide; and
   2. (b) shall furnish the policy summary required under Subsection 31A-22-1409(8).
