1. (1) A county recorder may accept a document presented for recording where the name of the entity as record owner in the LRMS is printed or typed exactly the same in the following sections of the document:

   1. (a) the grantor line;

   2. (b) the grantor signature block that also includes:

      1. (i) the name of the entity's authorized representative; and
      2. (ii) the authorized representative's title within the entity; and
   3. (c) the notary acknowledgement or jurat.

2. (2)(a) Where a grantor is an entity whose name on a document does not exactly match the name of the record holder entity due to a minor error in a previous document, then the county recorder may accept the document where the grantor section:

   1. (i) exactly matches the name of the correct grantor entity as printed or typed in the grantor signature block; and

      1. (ii) includes:

         1. (A) the correct name of the grantor entity;
         2. (B) language clarifying the correct grantor entity acquired title under an erroneous name in a previous document; and
         3. (C) the erroneous name of the grantor entity on the previous document.

   2. (b) A grantor entity section that substantially uses one of the following formats shall satisfy the requirements of Subsection R255-30-402(2)(a)(ii):

      1. (i) "_______ (here insert grantor entity's correct name), grantor, that acquired title as _______ (here insert grantor entity's name as it erroneously appeared in the previous document)"; or
      2. (ii) "_______ (here insert grantor entity's correct name), grantor, that erroneously acquired title as _______ (here insert grantor entity's name as it erroneously appeared in the previous document)".

3. (3)(a) Where the grantor is an entity whose name on a document does not exactly match the name of the record holder due to a name change, merger, acquisition, or conversion, the county recorder may accept the document where the grantor section:

   1. (i) exactly matches the name of the grantor entity as printed or typed in the grantor signature block; and

      1. (ii) includes:

         1. (A) the current name of the grantor entity; and
         2. (B) language clarifying that the current entity acquired title due to a name change, merger, acquisition, or conversion.

   2. (b) A grantor entity section that substantially uses one of the following formats shall satisfy the requirements of Subsection R255-30-402(2)(a)(ii):

      1. (i) for a name change:

         1. (A) "_______ (here insert grantor entity's current name), grantor, formerly known as _______ (here insert grantor entity's record holder name)"; or
         2. (B) "_______ (here insert grantor entity's current name), grantor, f.k.a. ________ (here insert grantor entity's record holder name)";

      2. (ii) for a merger:

         "_______ (here insert grantor entity's current name), grantor, by merger of _______ (here insert grantor entity's record holder name)";

      3. (iii) for an acquisition:

         "_______ (here insert grantor entity's current name), grantor, by acquisition of _______ (here insert grantor entity's record holder name)"; or

      4. (iv) for a conversion:

         "_______ (here insert grantor entity's current name), grantor, by conversion of _______ (here insert grantor entity's record holder name)".
