For the purpose of this subchapter—

1. (1) “employee” means a career appointee in the Senior Executive Service who—

   1. (A) has completed the probationary period prescribed under section 3393(d) of this title or section 1599e of title 10; or
   2. (B) was covered by the provisions of subchapter II of this chapter immediately before appointment to the Senior Executive Service; and
2. (2) “suspension” has the meaning set forth in section 7501(2) of this title.

Effective Date

Subchapter effective 9 months after Oct. 13, 1978, and congressional review of provisions of sections 401 through 412 of Pub. L. 95–454, see section 415 of Pub. L. 95–454, set out as a note under section 3131 of this title.
