1. (a) The Commission's decision is final and appealable:

   1. (1) if a motion for reconsideration is not filed on time, upon the expiration of the period for filing a motion for rehearing; or
   2. (2) if a motion for rehearing is filed on time, upon the date the order overruling the motion for reconsideration is rendered; the decision on the motion for rehearing is not rendered before the expiration of the deadline; or the motion is overruled by operation of law.
2. (b) A person who is aggrieved by a final decision of the commission in a contested case may seek judicial review of the decision. Judicial review of a final decision is under the substantial evidence rule.
