1. (a) ABTPA may authorize the licensure of ABTPA owned intellectual property.

2. (b) ABTPA will determine the monetary value of ABTPA intellectual property and will set license fees.

   1. (1) In determining an appropriate fee for licensure of ABTPA intellectual property, ABTPA will consider the:

      1. (A) commercial rates for comparable property;
      2. (B) development cost;
      3. (C) intended use of the property;
      4. (D) private or public status of the requestor; and
      5. (E) primary beneficiary of the license.

   2. (2) ABTPA may waive or reduce the amount of fees, royalties, or other monetary value to be assessed if the ABTPA determines that such waiver or reduction will further the goals and missions of the ABTPA and result in a net benefit to the state. In making this determination, ABTPA will consider whether:

      1. (A) the licensee is a governmental entity;
      2. (B) the intellectual property will be used for a commercial purpose;
      3. (C) ABTPA is the primary beneficiary of the licensee's use of the intellectual property; and
      4. (D) ABTPA has an interest in maximizing the distribution and use of the intellectual property.
