In the absence of director approval, the department will not refund a fee paid by a license applicant or a license holder if:

1. (1) the application or license is withdrawn, denied, suspended, or revoked; or
2. (2) the license applicant or license holder is subject to an unpaid civil penalty imposed against the license applicant or license holder by a final order.
