43 Tex. Admin. Code § 4.30
The sections under this subchapter set forth the Texas Transportation Commission's policy and procedures for implementation of a substance abuse program, evidencing the department's commitment to achieving an alcohol and drug-free workplace. An alcohol and drug-free workplace helps protect the health and safety of the department's most valuable resource, its employees, as well as the health and safety of the public. In addition, these sections are intended to demonstrate the department's commitment to rehabilitating and restoring employees whose performance may be impaired by alcohol or drug abuse. These sections also outline the policies and procedures required by 41 United States Code §§701-707, Title 33, Code of Federal Regulations, Part 95, Title 46, Code of Federal Regulations, Part 4, and Part 16, Title 49, Code of Federal Regulations, Part 382 and Part 40, and Title 28 TAC §169.2.
