1. (a) General provisions. A vehicle combination consisting of a truck-tractor and semi-trailer specifically designed with a tank and pump unit for transporting liquid fracing products, liquid oil well waste products, and unrefined liquid petroleum products to an oil well, and for transporting unrefined liquid petroleum products or liquid oil well waste product from an oil well not connected to a pipeline, may secure an annual permit issued under provisions of Texas Civil Statutes, Article 6701d-16, to haul liquid loads over all state-maintained highways.

2. (b) Application for permit.

   1. (1) A request for an annual permit issued under Texas Civil Statutes, Articles 6701d-16, must be submitted to the CPO by mail.
   2. (2) The permit request must be received by the CPO not more than 14 days prior to the date that the permit is to begin.

3. (c) Permit qualifications and requirements.

   1. (1) The semi-trailer must be of legal size and weight.
   2. (2) The semi-trailer must be registered for the maximum legal gross weight.
   3. (3) Only one semi-trailer will be listed on a permit.

   4. (4) The permit may be transferred from an existing trailer being removed from service and placed on a new trailer being added to the permittee's fleet, if the permittee supplies the CPO with:

      1. (A) the existing valid permit number;
      2. (B) the make and model of the new trailer;
      3. (C) the license number of the new trailer; and
      4. (D) a transfer fee of $31 per permit to cover administrative costs.

4. (d) Permit fee.

   1. (1) The permit fee is based on the axles of the semi-trailer and the drive axles of the truck-tractor. The fee for the permit is determined as follows:

      1. (A) $52 per axle--to haul liquid oil well waste products or unrefined liquid petroleum products from oil wells not connected by a pipeline and return empty;
      2. (B) $52 per axle--to haul liquid products related to oil well production to an oil well and return empty; and
      3. (C) $104 per axle--to haul liquid products related to oil well production to an oil well and return with liquid oil well waste products or unrefined liquid petroleum products from an oil well not connected to a pipeline.
   2. (2) Each permit will be charged a $20 issuance fee in addition to the permit fee.

5. (e) Permit movement conditions.

   1. (1) The permit load must not cross any load restricted bridge.
   2. (2) The permit is effective for one year beginning on the "movement to begin" date.
